ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. Present were: Council President Joe Duffle, Councilmembers Joan Hernandez, Pam Linder, Dennis Robertson, Verna Griffin, Kathy Hougardy, De'Sean Quinn. Jim Haggerton, Mayor; Rhonda Berry, City Administrator; Shelley Kerslake, City Attorney; Jim Morrow, Public Works Director; Pat Brodin, Public Works Operations Manager; Jack Pace, Community Development Director; Kimberly Walden, Municipal Court Judge; Mary Miotke, Information Technology Director; Kimberly Matej, Council Analyst; Christy O'Flaherty, City Clerk. SPECIAL PRESENTATIONS WashWise Program recognition of Tukwila businesses Mike Brent, Water Resources Manager, Cascade Water Alliance. Pat Brodin, Public Works Operations Manager, introduced Mike Brent, the Water Resources Manager for Cascade Water Alliance. Mr. Brent explained that Cascade Water Alliance has a variety of programs to promote water management and conservation. The WashWise Program encourages citizens to purchase high efficiency clothes washers. Two businesses in Tukwila have participated very successfully in the WashWise Program. Both Sears and Best Buy are being recognized this evening for their work toward water conservation as it relates to the WashWise Program. (A representative from Best Buy was not in attendance.) Ms. Orna Berg from Sears came forward to accept a Certificate of Appreciation "for outstanding contributions to regional water conservation by generating 915 WashWise Program rebates in 2007, saving 5 million gallons of water annually." Pat Brodin expressed appreciation to Sears and Best Buy for their participation in the program and conveyed thanks to Mike Brent for his leadership in facilitating the various needs of the member cities. The Mayor and Councilmembers thanked Ms. Berg, Mr. Brent, and Mr. Brodin for their ongoing efforts toward this important effort. City of Tukwila City Council Regular Meeting Minutes CITIZEN COMMENTS There were no citizen comments. Mayor Haggerton indicated there had been a citizen inquiry at the April 28 Council meeting regarding the Northfield Car Wash issue. Mayor Haggerton offered clarifying information regarding the settlement agreement on this matter. The original request from Northfield Car Wash had been for $1 million, as well as Northfield retaining the parcel of property on Tukwila International Boulevard adjacent to Southtowne Auto. Upon negotiation, the City agreed to pay Northfield $855,000, in two increments $580,000 would be paid on closing (April 29 -30, 2008); the balance of $275,000 would be placed in an interest bearing escrow account, payable to Northfield upon vacation of the property. The documentation indicates that Northfield is to cease doing business by September 30, 2008 and vacate the property by October 10, 2008. The City of Tukwila will have clear title to the property occupied by the Northfield Car Wash, as well as the parcel adjacent to Southtowne Auto. CONSENT AGENDA a. Approval of Minutes: 4/21/08 (Regular) b. Approval of Vouchers #3387834339115 in the amount of $1,018,865.75 MOVED BY DUFFIE, SECONDED BY HERNANDEZ TO APPROVE THE CONSENT AGENDA AS SUBMITTED. MOTION CARRIED 7 -0. UNFINISHED BUSINESS b. Authorize the Mayor to increase the hours in the Municipal Court by .50 FTE for an Administrative Support Assistant. Page 2 of 4 May 5. 2008 a. Authorize the Mayor to increase the hours of the Administrative Support Technician in the City Clerk's Office by .37 FTE (full -time employee equivalent). MOVED BY ROBERTSON, SECONDED BY DUFFIE TO AUTHORIZE THE MAYOR TO INCREASE THE HOURS OF THE ADMINISTRATIVE SUPPORT TECHNICIAN IN THE CITY CLERK'S OFFICE BY 15 HOURS OR .37 FTE (FULL -TIME EMPLOYEE EQUIVALENT). MOTION CARRIED 7 -0. MOVED BY ROBERTSON, SECONDED BY LINDER TO AUTHORIZE THE MAYOR TO INCREASE THE HOURS IN THE MUNICIPAL COURT BY .50 FTE FOR AN ADMINISTRATIVE SUPPORT ASSISTANT. MOTION CARRIED 7 -0. c. An ordinance adopting the Commute Trip Reduction (CTR) Plan. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING TUKWILA MUNICIPAL CODE SECTION 9.44, "COMMUTE TRIP REDUCTION PLAN AND PROGRAM REQUIREMENTS," TO REFLECT CHANGES IN STATE POLICY; ADOPTING THE TUKWILA COMMUTE TRIP REDUCTION (CTR) PLAN AND IMPLEMENTING MEASURES AS REQUIRED BY RCW 70.94.527; REPEALING ORDINANCE NO. 1868; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY LINDER, SECONDED BY DUFFIE THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED 7 -0. Shelley Kerslake, City Attorney, read the proposed ordinance by title only. MOVED BY LINDER, SECONDED BY HERNANDEZ THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. MOTION CARRIED 7 -0 TO ADOPT ORDINANCE NUMBER 2201. City of Tukwila City Council Reaular Meetina Minutes d. Authorize the Mayor to sign a contract with the City of Seattle for the provision of Hearing Examiner services. MOVED BY HERNANDEZ, SECONDED BY GRIFFIN TO AUTHORIZE THE MAYOR TO SIGN A CONTRACT WITH THE CITY OF SEATTLE FOR THE PROVISION OF HEARING EXAMINER SERVICES. MOTION CARRIED 7 -0. NEW BUSINESS Page 3 of 4 May 5. 2008 MOVED BY DUFFIE, SECONDED BY LINDER TO AUTHORIZE THE MAYOR TO SETTLE THE PENDING LAWSUIT WITH DOAK HOMES, CAUSE NUMBERS 07 -2- 171781 -9KNT AND 07- 1148MJP. THIS SETTLEMENT WILL INCLUDE LOT COVERAGE LIMITATIONS, DEVELOPMENT AND DESIGN STANDARDS, REFUND OF BUILDING PERMIT FEES, WAIVER OF PLAN CHECK FEES, CERTAIN INFRASTRUCTURE REQUIREMENTS AND OTHER TERMS NECESSARY TO CARRY OUT THIS INTENT. MOTION CARRIED 7 -0. REPORTS a. Mayor Mayor Haggerton reported he has been informed by staff from the Department of Community Development that a developer has expressed interest in building 300 condominium units in the area of the commuter rail station. The Mayor also reported that the Tukwila Village Request for Qualifications (RFQ's) resulted in responses from 9 developers. The list has been narrowed down to 3 developers for the project as follows: Opus, Legacy, and Tarragon. Additional information will be forthcoming on this issue. The Mayor also indicated that negotiations are on -going with LaPianta regarding the Tukwila South project. While some major issues have been resolved to the mutual satisfaction of both parties, there are discrepancies regarding revenue and expenditure projections in the first 8 -10 years that require continued discussion. On April 30, 2008 Mayor Haggerton attended a hard -hat tour of the Westfield Mall expansion, as well as the King County Regional Water Quality meeting. The Mayor also participated in the National Day of Prayer ceremony at the City Hall flagpole on May 1, 2008. b. City Council Councilmember Hernandez attended the Tukwila Children's Foundation Tea on April 26, 2008 and felt it was an exceptional event. She also attended the hard -hat tour of the Westfield Mall expansion on April 30, 2008. Councilmember Linder reported the Backyard Wildlife Fair is this Saturday, May 10, 2008. There will be 5 gardens available for touring to include her own yard, as well as the Macadam Winter Garden. Ms. Linder indicated she would be willing to make special arrangements for touring of her garden for those who cannot attend the event on May 10. Council President Duffie also attended the hard -hat tour of the Westfield Mall expansion on April 30, 2008. He conveyed that he recently participated in a Police Department ride -along during a midnight shift. Mr. Duffie had an opportunity to see the effectiveness of the Police Department K -9 Unit at work. He was also able to observe multiple incidents as they unfolded, and found it to be an eye- opening experience. Councilmember Hougardy also attended the hard -hat tour of the Westfield Mall expansion on April 30, 2008 and was impressed with the plans for the children's area and IMAX Theater. On May 1, 2008 she attended both the National Day of Prayer ceremony in Tukwila and the event for King County. City of Tukwila City Council Regular Meeting Minutes c. Staff There was no report. d. City Attorney There was no report. e. Intergovernmental Kimberly Matej, Council Analyst, indicated the first Council "Coffee Chat" will be held Saturday, May 17, 2008 at the Starbucks on Interurban Avenue from 9:00 a.m. -11:00 a.m. Council President Duffie will be hosting that event. This is the "testing" phase for Coffee Chats, and the Council will expand and add new locations based on citizen interest and participation.
