N ORDINANCE RELATING TO ENVIRONMENTAL Of 7s
IMPACT STATEMENTS, ESTABLISHING WHEN
THEY ARE REQUIRED AND PROVIDING FOR
REVIEW OF STATEMENTS DEEMED INSUFFICIENT.
WHEREAS The environmental policy acts of the United
States of America and of the State of Washington require the
filing of Environmental Impact Statements in connection with
the development of certain properties,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. Environmental Impact Statements shall be
required for any project or development which:
a. Exceeds a total project or development cost of
$100,000.00; or
b. Is of an industrial nature as that term is commonly
used; or
c. Is an allowable use under Tukwila Municipal Code
Chapters 18.40 and 18.42; or
d. Requires a shoreline management substantial develop-
ment permit.
Section 2. An Environmental Impact Statement in draft
or preliminary form, and subsequently in final form, may be re-
quired in the discretion of the Planning Coordinator in the
following cases:
a. When there is a change in use from non industrial
to industrial within an existing structure;
b. When it is proposed to store toxic or flammable
materials;
c. When re- zoning is proposed from residential
classification to any other classification when the uses allowed

within the proposed re -zone classification could have significant
adverse environmental effects, including but not limited to
excavating, filling or grading of existing soil or removal of
existing or natural vegetation.
Section 3. The cost of preparation of any Environmental
Impact Statement shall be borne by the applicant and /or developer.
Section 4, All Environmental Impact Statements shall

be prepared by a qualified consulting firm or laboratory. U4r.
Section 5. If in the opinion of the responsible review-
ing agency the Environmental Impact Statement is found to be
insufficient or inaccurate, the applicant and /or developer shall
assume the cost of a review by a separate, impartial consulting
firm or agency.
PASSED BY THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, and approved by the Mayor this 4Y/7 day of DFCemb-n
