Mayor Jim Haggerton called the Tukwila City Council meeting to order at 7:01 p.m. and led the audience
in the Pledge of Allegiance.

REGULAR MEETING MINUTES
Presentation of a proclamation recognizing community contributions. (Tukwila Treasure recipient)
Mayor Haggerton read a proclamation honoring Ms. Katrina Dohn as the 2008 "Treasure of Tukwila."
Ms. Dohn is a long -time resident of Tukwila, with over 20 years experience as a teacher at Tukwila
Elementary School. Ms. Dohn's past and present community contributions include involvement in Habitat
for Humanity, Tukwila Children's Foundation, C.A.R.E., Foster Tukwila Presbyterian Church, Young Life,
Book Baskets, crisis intervention, and a foster care provider. She has been described as "Tukwila's Good
Samaritan, a good neighbor, a friend to all, and truly a "Treasure of Tukwila."
Mayor Haggerton presented Ms. Dohn with the original proclamation and a plaque in honor of her
contributions to the Tukwila community.
Ms. Dohn conveyed her appreciation for this recognition and indicated she feels "blessed" to be a part of
Tukwila, where people work together for the good of the community.
The Mayor and Councilmembers each individually referenced Ms. Dohn's accomplishments and thanked
her for her selfless contributions to the community.

PUBLIC HEARINGS
Unclassified Use Permit and Design Review approval of the proposal to replace and expand the
existing Bow Lake Transfer /Recycling Station. Quasi Judicial
Mayor Haggerton stated this matter involves an application (submitted by King County Solid Waste
Division) for an Unclassified Use Permit (UUP) and Design Review approval to replace and expand the
existing Bow Lake Transfer /Recycling Station located at 18000 Orillia Road South. This is a quasi judicial
matter, and the City Attorney will go over the legal standard to be applied in this matter and ask the
Appearance of Fairness questions of the Council.
Shelley Kerslake, City Attorney, indicated this is a quasi judicial hearing before the Council this evening.
Appearance of Fairness questions will be asked of the Councilmembers, and criteria to be used in
deliberating the issue will also be provided.
7:16 p.m. Councilmember Quinn recused himself from discussion on this agenda item due to his
"occupation and employer" and left the Council Chambers.
The following 3 "Appearance of Fairness" questions were asked of each of the 6 Councilmembers:
1. Do you have any interest in the subject property (Bow Lake Transfer /Recycling Station at 18000 Orillia
Road South)?
2. Do you stand to gain or lose by your decision on this matter?
3. Have you had any ex -parte communications regarding this application?
Each of the 6 Councilmembers answered "NO" to all of the above questions.

Ms. Kerslake also asked if there was anyone who objected to the Councilmembers hearing this matter.
There was no response from the audience to this inquiry for each of the 6 Councilmembers.
Ms. Kerslake provided an overview of the 7 criteria for Unclassified Uses, applicable to this project, to
provide context to the Council when considering the testimony during the public hearing.
7:19 p.m. Mayor Haggerton opened the public hearing and called for citizen comments.
Mayor Haggerton reminded the Councilmembers that after the public hearing is closed this evening, no
new information may be brought forward for consideration. He encouraged the Council to ask any
necessary questions of staff or the applicant during the public hearing.
Minnie Dhaliwal, Planning Supervisor, utilized a Powerpoint presentation to provide an overview of this
project. Key elements of the presentation included:
Project Description
Demolition of existing 33,100 sq. ft. building (current Bow Lake Transfer Station)
-New Structures: 68,000 sq. ft. new transfer building; 2 scale facilities; maintenance building; transfer
trailer yard; recycling /yard waste facility; internal roadways /parking
Project Details
Site Layout: Improved on -site vehicular circulation with separation of self -haul, commercial and trailer
traffic; large trailer parking and maneuvering area; 21 parking stalls for customers and employees; new
sewer currently available. Sewer and storm water connection downhill.
Site Preparation contract to be conducted from October 2008 through October 2009
-Site Facilities contract to be conducted from November 2009 through Summer 2012
Landscaping
Perimeter landscaping along west property line will be partially located on Washington State Department
of Transportation (WSDOT) right -of -way
-Trees 92 retained on site; 417 removed; 450 replanted; and $12,920 fee in lieu of 710 trees (due to
space constraints)

Building Design
Transfer building consists of 2 levels, cast -in -place concrete substructure and clear span metal building,
with large translucent panels to provide natural lighting.
The primary gray tone is a receding color, with brighter colors used for accent on the structural supports.
The canopies and shed roof elements minimize the long rooflines.
The proposed building will be LEED (Leadership in Energy and Environmental Design) certified with
various sustainable building features, including rainwater collection in cisterns and natural day lighting
panels.
Ms. Dhaliwal referenced a letter (distributed to the Mayor /Council this evening) from Segale Properties,
dated July 30, 2008 and received by the City today, August 4, 2008, regarding this project. The letter
states in part "that La Pianta LLC is working with King County (County) to establish a permanent surface
water and sanitary sewer easement across our property that will provide surface water and sanitary sewer
conveyance from the County's reconstructed Bow Lake Recycling and Transfer Station to an area that is
commonly referred to as Ditch E and a connection to a possible future sewer line in the area. We have
granted the County a temporary construction easement so that they may begin construction of surface
water drainage facilities this year......"
Councilmember Robertson referenced paragraph 2 of the above letter that states, in part: "It is our
understanding that the City is requiring that the County provide assurances that future surface water and
sewer improvement plans will meet with our (Segale Properties) approval and that we will grant the
County the permanent easement needed." He asked Ms. Dhaliwal to provide input on this statement.
Ms. Dhaliwal indicated the City has not provided that information to King County. The City has conveyed
to King County that whatever surface water design they choose, it must meet the King County Surface
Water Design Manual.
Ms. Dhaliwal called attention to a model of the proposed new facility, available on display this evening.
The Councilmembers took a few moments to examine the building model.
In addition to Ms. Dhaliwal, the following members of the project team were also available to answer
questions and provide information:

Karl Hufnagel, Project Manager, R.W. Beck, Inc.

The Councilmembers had the following questions /concerns regarding this project (not shown in order of
priority):
1. The colors identified in the packet materials, on the building model, and on the sample chart
seem to differ in hue and intensity.
Charles Conway, Project Architect, KPG, Inc., explained the colors depicted on the building model are not
good representations of the true colors for the building. Grays, greens and rusts are being used to create
contrasts to break up the space. The colors seen inside the Council Chambers are different than what
will be displayed outside and from a distance.
2. Will stormwater runoff affect the Mess Cemetery in Tukwila?
Karl Hufnagel, Project Manager, R.W. Beck, Inc., indicated the pipeline for the stormwater is to the east
and not the south. The stormwater runoff is not near the site of the Mess Cemetery.

3. How was the number of parking stalls (21) determined?
4. How will dust and odor issues be handled?
6. Will the new facility continue to operate 24 hours a day?

Mr. Hufnagel relayed this number of stalls was needed due to the staffing levels. The facility will have 24-
hour a day service with triple shifts and staff overlaps.
Mr. Hufnagel explained that a sophisticated misting system is used for odor control. It involves a natural
plant oil odor neutralizer and is not a perfume cover -up. It was used at a transfer station in Seattle with
very effective results. The dust extraction system is located near the compactors in the facility (where
dust generates). Dust is pulled out of the air and collected in a bag filter system. Both of these systems
have been well proven throughout the country.
5. The chains, currently located in the facility that self haulers are subject to, seem cumbersome
and dangerous.
Brad Bell, Operations Manager, King County Solid Waste Division, expressed the new facility will operate
differently than the current Bow Lake Transfer Station. He explained that protecting customers from
falling and injuring themselves in the facility is necessary. King County has had experience, as well as
lawsuit issues, relative to customers who fell at the facilities. A 42" wall system will be in place in the self
hauling area and a cable system at the top of the wall to prevent customers from falling approximately 8'
to the floor below.
Mr. Bell indicated there will be 24- hour -a -day service Mondays through Fridays. The hours on Saturday
and Sunday are 8:30 a.m. to 5:30 p.m. During the construction period, self haulers will be able to come
in when the contractors are not working, and there should be no disruption to commercial haulers.
7. Should there be verbiage in the conditions directing that sewage "must" be hauled away in the
event a sewer line does not become available and that no septic tank can be installed?
Mr. Hufnagel gave his assurance there is no plan to install a septic tank on the site, partially due to the
soil quality and the building location being on an old landfill. The intent is to haul the sewage away if a
permanent sewer line is not available.
8. Were alternative options considered, such as burning garbage?
Mr. Hufnagel explained his firm has explored possible conversion technologies that involved a trip to
Germany to investigate the most modern waste energy methods. A report was provided to King County
for their review and consideration.
9. How was the fee assessed regarding payment, in lieu of planting trees?
Mark Epstein, Landscape Restoration Designer, ESA Adolfson, explained a tree survey was conducted
for the hundreds of trees located on the site of the proposed new facility. It was determined that 1,160
trees needed to be replaced. Smaller trees were selected due to the steep slope and their survivability
factor. Due to "running out of room" to plant all of the trees, the fee -in- lieu -of- planting option was
selected. The tree replacement cost was based on the price of the tree itself (at wholesale rates) and
labor toward installation.
10. Can Hazelnut trees be used in the tree planting (Tukwila means "Land Where the Hazelnuts
Grow
Elizabeth Gibson, Landscape Architect, KPG, Inc., explained one of the criteria for this project was based
on conditions set by the Port of Seattle. They conveyed the necessity to reduce plant material that is
conducive to bird populations (as transfer facilities attract birds). The tree list provided by the Port of
Seattle (since this is on a flight path to Seatac Airport) does not contain Hazelnut trees.

11. Is there a plan in place for the trees to be adequately maintained?
Minnie Dhaliwal, Planning Supervisor, said the monitoring plan would require watering for the first 2
growing seasons until the trees are established.
12. Will improvements be made to the free recycling area, as this spot in the current facility is
"messy
Mr. Hufnagel relayed there are no significant improvements planned for the free recycling area. There
may be the addition of a kiosk and public notices section. Additional screening and fencing could be
considered to reduce litter and messiness.
13. Due to the heavy traffic in this area, was consideration given to making access
improvements?
Neil Fujii, Managing Engineer, King County Solid Waste Division, explained the traffic issues in this area
stem from regional issues. Assessments performed regarding transportation- related issues in this area
disclosed that traffic problems would remain, regardless of whether or not the King County Transfer
Station was located at this site.
14. What route will the trucks follow to remove the waste products off -site?
Ms. Dhaliwal explained that the majority of products are taken to the Cedar Hills Landfill by getting on 1 -5
north and exiting to 1 -405.
15. What, if any, noise impacts are there to the surrounding area?

Mr. Hufnagel indicated a noise study was conducted by a noise engineering firm. Sound readings were
taken at various places near the site, in addition to a residential area above Seatac. The report indicates
the facility will be in conformance with all of the noise ordinances applicable to this site.
Neil Fujii, Managing Engineer, King County Solid Waste Division (applicant for the project), thanked the
Council and City staff for their responsiveness to this project.
a. Adopt the Findings of Fact, Conclusions, and Recommendations contained in the staff report
and approve the Unclassified Use Permit (UUP) and Design Review Application to replace and
expand the existing Bow Lake Transfer /Recycling Station currently located at 18000 Orillia Road
South.

REPORTS
a. Mayor
Mayor Haggerton reported that business license issuance has increased in 2008. A total of 2,350
licenses were issued in 2007; to date in 2008, 2,400 licenses have been issued. The Mayor indicated the
National Night Out Against Crime event in Tukwila is Tuesday, August 5, 2008. He reminded the Council
to meet at the 6300 Building (Conference Room #5) at 4:15 p.m. tomorrow to pick up their packets for the
event. The Mayor indicated Tukwila has been chosen as the starting point for the 2009 Rock and Roll
Marathon event, scheduled for June 27, 2009. This event usually attracts 20,000 to 30,000 people, and
the route will travel north from Tukwila and end at Qwest Field.
b. City Council
Councilmember Hernandez reported she has encouraged her neighbors to become involved in the Block
Watch program. Her neighbors will be hosting a dessert potluck for the Night Out Against Crime event.
She indicated the Equity and Diversity Commission meeting will be held at Tukwila City Hall on August
2008 at 5:00 p.m.
Council President Duffie thanked Jim Morrow, Public Works Director, for a tour of the levee site and areas
near Gateway Drive.
Councilmember Hougardy reported she will be assisting with the Night Out Against Crime event in her
neighborhood.

Councilmember Quinn hosted the Council Coffee Chat on August 2, 2008. It was conveyed to him that
there are several unreported accidents near the driveway of the golf course, involving pedestrians and
bicyclists being hit by cars. He would like the City to investigate this matter. Mr. Quinn referenced the
recent tanker accident on 1 -5 that caused vehicle traffic to flood the streets in Tukwila. He would like to
see Tukwila pursue options and possible grant funding to mitigate similar traffic issues when the viaduct
in Seattle is replaced.

d. City Attorney
There was no report.
e. Intergovernmental
Kimberly Matej, Council Analyst, passed around the gift received from the recent visit by the delegation
from Miyoshi, Japan (Tukwila's Sister City). The gift is a gold- trimmed platter, depicting birds in flight.
She reminded the Council that Tukwila Days is coming up on August 16, 2008.
MISCELLANEOUS
Councilmember Linder encouraged the Councilmembers to read the recent version of the Rental Housing
Industry News Update, which features an article regarding Tukwila.
