AMENDED REPEALED Section(s) Amended Amended by Ord # Section(s) Repealed Repealed by Ord # 2430 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, AMENDING THE CITY'S PARKS, RECREATION AND OPEN SPACE PLAN, ADOPTED BY ORDINANCE NO. 2207, TO ESTABLISH LEVEL OF- SERVICE (LOS) STANDARDS; IDENTIFYING CAPITAL FACILITIES NEEDED TO MAINTAIN LOS STANDARDS FOR FUTURE GROWTH; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, RCW 35A.63.062 sets forth a city's option to perform comprehensive parks and open space planning; and WHEREAS, on June 23, 2008, the City passed Ordinance No. 2207, adopting Tukwila's most recent Parks, Recreation and Open Space Plan; and WHEREAS, the City Council desires that the Parks, Recreation and Open Space Plan include standards for measurement of acceptable levels of parks services provided by the City; and WHEREAS, the City Council desires to identify capital facilities needed to maintain level of- service standards for future growth; and WHEREAS, on August 25, 2008, the City Council held a public hearing to present and receive public comment on the Parks and Recreation level -of- service standards; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY ORDAINS AS FOLLOWS: Section 1. Level of Service. Capital Facilities Identified. The City's Parks, Recreation and Open Space Plan, adopted by Ordinance No. 2207, is hereby amended with the addition of a "Project List for Parks Capital Facilities Related to Future Growth," attached hereto as Exhibit A, and by this reference incorporated as if fully set forth herein. Section 3. Severability. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance or its application to any person or situation should be held to be invalid or unconstitutional for any reason by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this ordinance or its application to any other person or situation. Section 4. Effective Date. This ordinance or a summary thereof shall be published in the official newspaper of the City, and shall take effect and be in full force five days after passage and publication as provided by law.
