While the approved plans call out a north property line setback of 15 feet, I approved a revision to allow the structure to be placed approximately 8.5 feet from the north property line. Facts considered in making this decision included: • At the time of this decision, considerable work had been undertaken by the owner's contractor to set and prepare forms for the building foundation in a location approximately 8.5 feet from the north property line. Considerable time and expense would have been involved in moving the forms to meet the 15 foot setback as shown on the approved plans. • The project site is located within the LDR Low Density Residential Zoning District. The Tukwila Zoning Code allows 5 foot-side yard setbacks in the LDR District. - • A spring -fed watercourse runs approximately 2.5 feet inside of the north property line. • The approved plans for the residence authorize the placement of this watercourse in a culvert in the general vicinity of the residence. • It would be preferable, from a water quality and a maintenance standpoint, for this watercourse to remain open as much as possible. The Tukwila Sensitive Areas Ordinance expresses a strong preference for avoiding placing such watercourses in culverts. • Mr. Lacy agreed to work with the City to maintain the watercourse open, as long as it does not pose a threat to his house or property. • Mr. Lacy's geotechnical engineer indicated he had inspected the site and determined the proximity of the proposed foundation to the existing watercourse creates no concern regarding foundation stability. A -Team Excavation was on the site excavating the second interceptor trench lateral on the slope, and cutting the building pad. The lateral had been excavated. Filter Fabric and washed rock envelope was in place and 4 -inch perf pipe was connected to the perimeter lateral at each end. Contractor was keeping trench open for City of Tukwila inspection. The Contractor thought that excavation for the pad was within one foot of grade. Slight seepage was evident in the cut face in two locations. I asked contractor to take picture of locations. Some sloughing had occurred overnight. Collected water was directed toward existing drainage and routed through vegetated area. Swales constructed last year appear adequately vegetated to control sedimentation and erosion to within pre - existing conditions. I discussed the following with the operator and A -Team foreman: 1. Perimeter silt fence and erosion control must be in place prior to excavating near the edge of the site. 2. Gravel berm with filter- wrapped envelope ( "burrito ") should be constructed at locations where silt -laden water is discharged from pad. This applies to temporary drainage from pad currently constructed. 3. Area around existing catch basin needs to be regraded to conform to plans, forming a shallow depression and armored with quarry spalls. Maple should be removed. 12 -inch pipe outlet must also be protected with quarry spalls. 4. When catch basins are installed, they should be outlet protected with fabric placed over wire mesh and covered with washed rock. 5. In discussion with owner and excavation contractor, the plan for the pad and footings has been revised to: • Excavate the pad to competent material and grade and then cover with 4" to 6" of crushed concrete to provide a working surface. • • • Footings may be excavated through working pad, bearing verified by geotechnical engineer, and then may be protected with thin (2" of crushed rock) layer of rock compacted in trench with plate compactor to provide working surface for placing forms and steel. • Front portion of foundation has been revised to consist of spread footings and high stem walls, backfilled and compacted on both sides with material after forms have been stripped. Exposed height shall not exceed 4 feet max when backfilled. This is to take advantage of short window of weather. 6. Contractor should construct the entrance for distance of 100 feet once it has been cut to grade by providing quarry spalls and directing drainage to a sump with sedimentation control. The pad stepped down about 2 feet at the northern half of the building footprint. The far northern portion of the pad revealed soft silty sand. Exposed native subgrade appears as silty fine to medium sand, and some portions of silty sand with trace of gravel. No springs appeared to surface or v'thin the pad at the time of our inspection. I discussed the following with the operator and A -Team foreman: l.. The northern 10 to 15 feet of the pad appeared to contain loose, soft, or disturbed soils that were also saturated from recent rain. I instructed the contractor to overexcavate the area and either place footings there on native, undisturbed, soil, or build up with structural fill. The owner was on site, and the decision was made to use imported material. 2. 1 instructed the contractor to wrap the imported, crushed drain rock with Mirafi 700X or equivalent filter fabric to prevent migration of neighboring fines into the area. The pad was excavated to native, undisturbed soils demonstrating at least 2,000 psf. From that point the pad was built up using well- graded, crushed, recycled concrete, compacted in lifts utilizing a 38001b vibratory steel wheeled roller. Other portions of the pad received a thin layer (less than 6- inches) of 2 -inch to fl- inch recycled concrete tamped into the native sand, and then compacted with the roller, in order to provide a working surface in the pad for the foundation. The building pad is now suitable for foundation construction. After the last 36 hours of rain, the site drainage appears to be functioning well. All subsurface interceptors are discharging clear water. The surface swales are directing water around the pad to catch basins or existing drainage ditches. The surface water near the top of the existing construction entrance (where a later culvert is planned) currently discharges onto the construction entrance and drains toward the cul -de -sac. I discussed the following with the operator and A -Team foreman: 1. Clean out and enlarge the primary sediment trap upstream from the existing culvert under the access road. Efforts should include the following: • Enlarge the sediment trap or sump area, disposing of silt and sand where it will not contaminate the drainage from the site. • Construct a gravel berm consisting of filter fabric - wrapped drain rock, armored with recycled concrete (2 -inch to 4 -inch clean). The trap should be maintained after each storm event. • Remove existing filter fence and replace with new fence downstream from the gravel berm and in front of the culvert opening. No water should leave the sediment trap without first passing through the gravel berm with filter fabric envelope and the silt fence. • Armor the side slope of the sump with 2" to 4" concrete and cover the loose stockpiles with plastic sheeting and sand bags. Add rock check dams about every 15 feet along drainage way from discharge of pipes to sediment trap. 3. Construct a small drainage way across the construction entrance that drains water leaving the site into a small sump surrounded with filter fabric silt fence. The sump should be on the north side of the entrance out of way of turning trucks. Hay bales may also be used to retain sediment on site. 4. All other exposed soils outside the building footprint should be mulched with straw for the winter. 5. Periodic maintenance of the erosion control measures and sediment traps shall be the responsibility of the owner /contractor. While the approved plans calf out a north property line setback of 15 feet, I approved a revision to allow the structure to be placed approximately 8.5 feet from the north property line. Facts considered in making this decision included: • At the time of this decision, considerable work had been undertaken by the owner's contractor to set and prepare forms for the building foundation in a location approximately 8.5 feet from the north property line. Considerable time and expense would have been involved in moving the forms to meet the 15 foot setback as shown on the approved plans. • The project site is located within the LDR Low Density Residential Zoning District. The Tukwila Zoning Code allows 5 foot side yard setbacks in the LDR District. • A spring -fed watercourse runs approximately 2.5 feet inside of the north property line. • The approved plans for the residence authorize the placement of this watercourse in a culvert in the general vicinity of the residence. • It would be preferable, from a water quality and a maintenance standpoint, for this watercourse to remain open as much as possible. The Tukwila Sensitive Areas Ordinance expresses a strong preference for avoiding placing such watercourses in culverts. • Mr. Lacy agreed to work with the City to maintain the watercourse open, as long as it does not pose a threat to his house or property. • Mr. Lacy's geotechnical engineer indicated he had inspected the site and determined the proximity of the proposed foundation to the existing watercourse creates no concern regarding foundation stability. MEMO FOR RECORD DATE: 6/19/98 FROM: Duane Griffin, Building Official SUBJECT: Mr. Lacy's Request for Extension dtd 6/12/98 (Permit #D97 -0391) I called Mr. Lacy at 11:45 AM on 6/19/98 and told him that I couldn't grant an extension based on his written request because there wasn't anything in it that indicated the extension was needed because of circumstances beyond his control. He said that he had been told something different when he had inquired at the front desk and his understanding was that all he had to do was request an extension, but if that wasn't the case he would come in and pay for the permits and pick them up not later than next Tuesday (6/23/98). We discussed the reasons for the180 day code requirements regarding the issuance of permits and he seemed satisfied with my explanation. I also told him that if he picked up his permit not later than next Tuesday there would be no issue about the few days we have gone past the expiration date shown on the permit application. The following is my justification for not approving the request for extension: Section 107.4 of the UBC states: "Application for which no permit is issued within 180 days following the date of application shall expire by limitation, and plans and other data submitted for review may thereafter be returned to the applicant or destroyed by the building official. The building official may extend the time for action by the applicant for a period not exceeding 180 days on request by the applicant showing that circumstances beyond the control of the applicant have prevented action from being taken. No application shall be extended more than once. In order to renew action on an application after expiration, the applicant shall resubmit plans and pay a new plan review fee." The following information is taken from the Handbook to the UBC: Sec 107.4 Expiration of Plan Review. When a permit has not been issued within 180 days following the date of application, the application and plan review expire.
