BACKGROUND The Small Drainage Program constructs drainage projects throughout the City that are too large for City staff to complete, but are smaller than a typical capital improvement project. The projects originate from citizen complaints and maintenance staff and are compiled on the Small Drainage Project List. Each year the projects are prioritized based on need, expense, permitting requirements, and length of time on the list. The highest priority projects are then designed and constructed. The 2013 Annual Small Drainage Program will provide drainage improvements at four locations listed on page 2 of this memo. ANALYSIS The 2013 Annual Small Drainage Program was advertised for bids on July 30 and August 6, 2013. Six bids were received and opened on August 13, 2013. The bids were checked and tabulated. Henderson Partners, LLC is the apparent low bidder with a bid of $339,049.00. The engineer's estimate was $409,850.00. Henderson Partners, LLC has successfully constructed other municipal projects but has not done work with the City of Tukwila. BUDGET AND BID SUMMARY (All amounts include sales tax.) Site 2) 33rd Ave S — Provide a drainage system on 33rd Ave S between S 140th St and S 142nd St to eliminate roadway runoff from entering private property. Site 3) 33rd Ave S to 35th Ave S — Replace three existing failing catch basins and repair asphalt within a public drainage easement. Site 4) S 164th St to 53rd PI S — Replace an existing failing storm pipe and replace two catch basins within a public drainage easement. BACKGROUND The 2013 State Legislature has provided funding through two separate appropriations: 1. $5.85 million for the 2013 -2015 Biennial Municipal Stormwater Capacity Grant Program of which NPDES Phase I and II communities will be awarded $50,000 for NPDES permit compliance activities. 2. $15 million for Project Specific Planning and Design for Retrofit /LID Projects, of which up to $120,000 is available for each of the NPDES Phase I and II communities. ANALYSIS Both grants are non - competitive and no matching funds are required. The City must submit the Grant Acceptance Intent Notice (GAIN) by August 30, 2013 indicating the acceptance or decline of the Project Specific Planning offer, which is design funding. Staff has identified the East Marginal Way South Stormwater Outfalls project for this grant funding. Attached is the project specific CIP page. RECOMMENDATION Council is being asked to accept the two NPDES grants and consider this item on the Consent Agenda at the September 3, 2013 Regular Meeting. If the RECIPIENT is out of compliance with the municipal stormwater National Pollutant Discharge Elimination System (NPDES) permit, the RECIPIENT must ensure funds are used to attain compliance where applicable. B. The RECIPIENT may conduct work related to implementation of additional activities required by the municipal stormwater NPDES permits. The following is a list of elements your project may include. Please check all boxes that apply to your project. Public education and outreach activities, including stewardship activities Public involvement and participation activities Illicit discharge detection and elimination (IDDE) program activities, including: 1. Mapping or geographic information systems of municipal separate storm sewer systems (MS4s); 2. Staff training; 3. Activities to identify and remove illicit stormwater discharges; 4. Field screening procedures; 5. Complaint hotline database or tracking system improvements. Activities to support programs to control runoff from new development, redevelopment, and construction sites, including: 1. Development of an ordinance and associated technical manual or update of applicable codes; 2. Participation in applicable watershed planning effort. Pollution prevention, good housekeeping, and operation and maintenance program activities, such as: 1. Inspecting and /or maintaining the MS4 infrastructure; 2. Developing and /or implementing policies, procedures, or stormwater pollution prevention plans at municipal properties or facilities. Annual reporting activities. Establishing and refining stormwater utilities, including stable rate structures. Water quality monitoring to implement permit requirements for a Water Cleanup Plan (TMDL). Note that any monitoring funded by this program requires submittal of a Quality Assurance Project Plan that Ecology approves prior to awarding funding for monitoring. Monitoring, including: 1. Development of applicable QAPPs ; 2. Monitoring activities, in accordance with an Ecology- approved QAPP, to meet Phase I/II permit requirements; Structural stormwater controls program activities (Phase I permit requirement) Source control for existing development (Phase I permit requirement), including: 1. Inventory and inspection program; 2. Technical assistance and enforcement; 3. Staff training. Equipment purchases that result directly in improved compliance with permit requirements. Allowed costs for equipment purchases must be specific to implementing a permit requirement (such as a vactor truck) rather than general use (such as a general use pick- up truck). JUSTIFICATION: Drainage from E Marginal Wy S is discharged through outfalls owned and operated by the Boeing Co., Jorgensen Forge, and two King County Airport storm systems without easements. STATUS: Jorgensen Forge outfall was closed in 2011 under an order from the US EPA. The Boeing Company contacted the City in 2009 requesting that the City take over ownership of their storm line and outfall. MAINT. BACKGROUND On August 1, 2013, additional requirements to the City's Phase II Municipal Stormwater Permit went into effect. One of the conditions of the permit requires the City to either monitor stormwater systems within the City for water quality effectiveness or participate in a regional monitoring effort sponsored by the DOE. The City must notify the DOE in writing by December 1, 2013 of our decision. ANALYSIS There are three stormwater monitoring requirements: 1. Status and Trends (measure whether things are getting better or worse and identify patterns in healthy and impaired Puget lowland streams and Puget Sound urban shoreline areas). 2. Effectiveness Studies (provide widely applicable information about what works and what doesn't work in certain situations, and how to improve stormwater management). 3. Source Identification and Diagnostic Monitoring (provide information about source identification and elimination methods and identify opportunities for regional solutions to common illicit discharges and pollution problems). Staff has reviewed the monitoring requirements and concluded that it would be more cost effective for the City to participate in the DOE's regional monitoring program. FINANCIAL IMPACT Annual costs will be $12,536.00 to conduct all three stormwater monitoring requirements for the duration of this five year permit term. RECOMMENDATION Information only.
