HomeMy WebLinkAboutOrd 0727 - Shoplifting (Repealed by Ord 1095) RE1 E ALE BY o q_.3 (0) b, /D06 Ci TY O F TUK WILA WASHINGTON ORDINANCE NO. 727 lAk/ AN ORDINANCE AMENDING ORDINANCE NO. 570 AND CHAPTER 8.04 OF THE TUKWILA MUNICIPAL CODE, DECLARING SHOPLIFTING TO BE AN UN- LAWFUL ACT, AUTHORIZING ARREST FOR SHOP- LIFTING WITHOUT WARRANT, ESTABLISHING REASONABLE CAUSE AS A DEFENSE TO ANY CIVIL OR CRIMINAL ACTION FOR FALSE ARREST, FALSE IMPRISONMENT OR WRONGFUL DETENTION AND DEFINING PEACE OFFICER. THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: That Ordinance 570 be amended by adding thereto three additional section as follows: SECTION 21. Shoplifting. It is unlawful for any person wilfully to take possess- ion of any goods, wares or merchandise of the value of less than $75.00 offered for sale by any wholesale or retail store or other mercantile establishment without the consent of the seller, with the intention of converting such goods, wares or merchandise to his own use, without having paid the purchase price thereof. SECTION 22, Arrest Without Warrant Authorized when: A peace officer may, upon a charge being made and without a warrant, arrest any person whom he has reasonable cause to believe has committed or attempted to commit the crime of shoplifting. SECTION 23. Reasonable Cause Defense to Civil or Criminal Action Brought by Suspect. Reasonable cause shall be a defense to a civil or criminal action brought for false arrest, false imprisonment or wrongful detention against a peace officer by a person suspected of shoplifting. -1- r SECTION 24. Peace Officer Defined. For the purposes of this chapter, "peace officer" means a duly appointed city, county or state law enforcement officer.
