Regular Meeting
February 17, 2009 7:00 P.M.
Mayor Haggerton called the Tukwila City Council meeting to order at 7:04 p.m. and led the audience in
the Pledge of Allegiance.
Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie,
Joan Hernandez, Pam Linder, Dennis Robertson, Verna Griffin, Kathy Hougardy, De'Sean Quinn.

SPECIAL PRESENTATIONS
a. Appointment of Abdisamad Egal to Position #2 on the Community Oriented Policing Citizens'
Advisory Board (COPCAB), with a term expiring 3/31/2010.

Mr. Egal indicated he is from Somalia and is the owner of the Shabelle Internet Cafe at 14822 Tukwila
International Boulevard. He is thankful for this opportunity to build a relationship with the City and serve
the community.
The Councilmembers thanked Mr. Egal for his willingness to volunteer his time in service to the City of
Tukwila by participation on the Community Oriented Policing Citizens' Advisory Board.

b. Seattle Southside Community Report Katherine Kertzman, Tourism Manager
Katherine Kertzman, Tourism Manager, came forward and gave a PowerPoint presentation on tourism
activities in 2008. Key points of the presentation included:
2008 statistics on the economic impact of tourism in the state: In 2008, visitors spent $15.7 billion;
travel spending generated 149,900 jobs; tax revenue was $1 billion; overnight visitors spent $6.8
billion
Getting around: Visitors arrive by air (49 auto (47 other (4 Air travel through Seattle
Tacoma Airport peaked at over 32 million passengers; Seattle Southside's Tukwila Amtrak
Station saw an increase in passengers by nearly 16 cruise travel reached over 433,000
embarkations and is expected to remain consistent
Seattle Southside hotel revenues were $217,870,400 in 2008, up from $211,967,141 in 2007
Shopping is the #1 tourist activity, and ridership was up 10% on the Seattle Southside Shuttle
Seattle Southside was featured as a West Coast family vacation under $250 on AOL Travel
In October, Katherine Kertzman was appointed to the Washington State Governor's Tourism

The Councilmembers thanked Ms. Kertzman for the informative presentation and the excellent work
performed year- round.
Council President Hernandez requested Ms. Kertzman provide an overview of the awards received by
Seattle Southside.
Ms. Kertzman indicated Seattle Southside won the first place Totem Award for the Tukwila Life
Campaign, a first place Totem Award for the time capsule unveiling, and a Certificate of Excellence for
the Centennial Kick -off campaign.
Mayor Haggerton explained there was a great deal of competition for these awards, and Tukwila can be
proud of the achievements.

Council President Hernandez indicated that each of the Human services contracts was previously
discussed at the Community Affairs and Parks Committee meeting and at the Committee of the Whole.
1. Authorize the Mayor to sign a contract with Catholic Community Services for emergency
assistance in the amount of $28,794.00.

REPORTS
a. Mayor
Mayor Haggerton attended the Leadership Retreat involving City Department Heads and managers on
February 10, 2009. The purpose of the meeting was to evaluate last year's activities, the current situation,
and future outlook for each department. The meeting was very informative.
On February 11, 2009, the Mayor attended the Valley Com Communications Strategic Positioning
Meeting. On February 12, 2009, he attended the Watershed Ecosystem Meeting. Discussion at the
meeting included financing of the river cleanup and salmon restoration. That same day he also met with
Chuck Clark, the new CEO of the Cascade Water Alliance.
The Mayor reported that he and the City Administrator met with Deborah Entenman from Representative
Adam Smith's Office. The condition of the Green River and the Howard Hanson Dam were among the
items discussed, and Ms. Entenman expressed support for the SCORE jail project.
b. City Council
Councilmember Duffie met with the Police Department and the School Board regarding gang activity in
the City. Youth services agencies in the area have a boot camp for troubled youth. He would like to see
more information come before the Council on this issue, as well as information from a meeting on poverty
he recently attended.
Councilmember Linder staffed the Council Chat on February 14, 2009. She indicated there were a few
people from unincorporated King County who attended the Chat. In her view, the prior chats at the
Tukwila Trading Company seemed to attract a greater number of participants. Ms. Linder also indicated
there may be a need to expedite communication plans regarding the dam, pursuant to a letter she
received from King County.
Council President Hernandez attended a banquet on February 11, 2009, wherein Seattle Southside
received three awards. On February 12, 2009, Ms. Hernandez attended the Seattle Southside Tourism
Lunch. Representatives from Tukwila, SeaTac, Kent and Des Moines also attended.
Councilmember Robertson attended the South County Area Transportation Board (SCATBd) meeting on
February 17, 2009. The tunnel in Seattle is expected to open in late 2015, and the viaduct will not come
down until after the tunnel opens. Consideration of tolling is underway to finance the tunnel. King County
is also proposing a Motor Vehicle Excise Tax, which will require a state law change. Councilmember
Robertson suggested the City wait until all information on this issue has been presented before taking a
legislative position.
Councilmember Griffin reported that a neighbor in her area has a salmon incubator, and on February 15,
2009, thousands of baby salmon were released into the creek. It is her understanding that water quality
seems to be improving in the creek, thanks to improvements in the area of Tukwila International
Boulevard, and more salmon are surviving and returning.
Councilmember Hougardy attended the Suburban Cities Association Public Issues Committee Meeting on
February 11, 2009. Issues regarding the rental housing inspection program were discussed.
Councilmember Quinn thanked Council and staff for work on Human Services. Mr. Quinn indicated House
Bill 1790 (domestic violence court order violations) has relevance to Tukwila as a city, and it appears the

City is ahead of the curve. Councilmember Quinn requested that members going to Olympia review the
bill in order to be prepared.
c. Staff
Rhonda Berry, City Administrator, reported that the City Clerk's Office now has an automated cashiering
system and MasterCard and Visa will be accepted for City transactions.
d. City Attorney
There was no report.
e. Intergovernmental
Kimberly Matej, Council Analyst, indicated she has distributed packets for rental housing that should be
put in the binders the Council will be taking to Olympia for the Association of Washington Cities event this
week.
MISCELLANEOUS
Councilmember Linder spoke with Cecile Hansen, Chairwoman of the Duwamish Tribe. They need to
raise $100,000 to have a special researcher identify artifacts and provide verification regarding tribal
status issues. A luncheon will be held on February 25, 2009 to raise funds.
Council President Hernandez indicated Kimberly Matej is finalizing agenda topics for the retreat and
requested that Councilmembers send suggestions to her before February 27, 2009.
Mayor Haggerton reported the Finance Director has completed the analysis of the first quarter
streamlined sales tax mitigation. The analysis found $122,000 in misclassifications for the first three
month period. It is expected that it should be corrected in future quarters.
Councilmember Robertson indicated he and the Code Enforcement Officer, Kathy Stetson went to
Olympia regarding Senate Bill 5495 (Rental Housing Inspections). Mr. Robertson inquired how hard the
Council wants to push on these bills, and how much direction the Council wants to give Administration.
There is the possibility of a legal challenge going forward.
Councilmember Duffle indicated Council's support of the bill is necessary to protect the citizens and to
have landlords honor their responsibilities.
Councilmember Linder conveyed her appreciation for the work Code Enforcement staff and the attorneys
have done over the years on this program. Ms. Linder felt it is the Council's obligation to protect Tukwila's
vulnerable population.
Council President Hernandez stated it is the Council's obligation to assist low- income citizens who may
be fearful of reporting substandard living conditions due to the possibility of eviction. The level of
awareness needs to be raised.
Councilmember Griffin indicated this program hits home because she knows people living in these
conditions. These people, oftentimes, are not aware they do not have to live in such poor conditions.
Councilmember Hougardy inquired of Kathy Stetson, Code Enforcement Officer, if there were any other
statements she would like to make other than what is outlined in the letter. Ms. Hougardy also noted that
strategy is important in these matters.
Ms. Stetson indicated her full report and the letter summarize her concerns on the subject.
Councilmember Quinn thanked Ms. Stetson for going to Olympia to address the rental housing bill. It is an
infringement on the City's right to protect the health and safety of its citizens. Low- income citizens do not
have options or a voice; the Council is their voice.

Shelley Kerslake, City Attorney, explained the City had been waiting for a decision in a lawsuit involving
the City of Pasco before implementation of a rental housing inspection program. The City of Pasco had
offered options for landlords to either hire a City inspector or to hire their own inspector. The Court
upheld Pasco's ordinance due to this provision. Two bills currently proposed in the legislature at this time
are proposing that fees for use of City inspectors cannot be passed onto a landlord. This presents a
problem for a program with the goal of being revenue neutral. The proposed language has nothing to do
with search and seizure, with the primary concern that costs not be passed along to landlords. Ms.
Kerslake indicated that if the newly proposed legislation is enacted, the City can still proceed with a rental
housing inspection program.
Councilmember Duffie inquired what the Council can do to bring awareness to rental apartment owners
that the City will not tolerate substandard living conditions. Ms. Kerslake responded that the Council is
free to talk to community groups in their official capacity.
Councilmember Robertson emphasized the need to oppose the House and Senate bills. He suggested
that staff can continue to review the draft ordinance and make changes that may be needed.
Mayor Haggerton indicated he would pursue the issue with the Association of Washington Cities (AWC)
Board of Directors.
