HomeMy WebLinkAbout92-136 - Duwamish Improvement Club - 12232 43rd Avenue South Lease• LEASE AGREEMENT A 40 FILE # ..e24 DATE eev This Lease Agreement is made as of thisog3 —'day of October 1992, by and between the City of Tukwila, a Washington municipal corporation, as Lessor, and the Duwamish Improvement Club, a not- for-profit community organization incorporated under the laws of the State of Washington, as Lessee.. 1. Term. The term of this lease shall be for a period of one year from the date first written above, and automatically renewable for one-year periods thereafter, unless first terminated by either party upon ninety (90) days' written notice prior to the end of any such one-year period. 2. Leased Premises. The property subject to this lease is commonly known as 12232 43rd Avenue South in Tukwila, consisting of a residential lot and small concrete building. The Duwamish Improvement Club has used these premises for many years for club activities, meetings, and fund raisers and it is the intent of this lease to allow those activities to continue. 3. Insurance and Indemnity. Tenant shall obtain and maintain continuously public liability insurance and/or other insurance necessary to protect the public on the premises leased, with limits of liability not less than: $300,000 combined single limit personal injury/property damage LEASE AGREEMENT - Page 1 DICLEASE.001 Such insurance shall include the City of Tukwila as an additional insured and shall not be reduced or canceled without thirty (30) days written prior notice to the City of Tukwila. The Tenant shall provide a certificate of insurance, or upon written request to the City of Tukwila, a duplicate of the policy as evidence of the insurance protection provided. 4. Utilities. The Duwamish Improvement Club agrees to be responsible, and pay, for all utility costs associated with the leased premises including but not limited to heat, power, and water. The City of Tukwila shall pay all surface water assessments. 5. Rent. The Duwamish Improvement Club agrees to pay the sum of $10 per year for rent and also agrees to be fully responsible for all required internal and external repair and maintenance, including yard work, other than normal wear and tear. The City of Tukwila agrees to furnish free of cost any materials required for internal and external repairs directed by the City. 6. Reservation of Rights. The City of Tukwila currently has no known use for the leased premises but reserves all rights to use the leased premises at any time not already scheduled by the Duwamish Improvement Club. Any use by the City of Tukwila will be coordinated with the Duwamish Improvement Club to allow for property accountability and the coordination of scheduling. 7. Capital Improvements. The Duwamish Improvement Club may, but is not required to, make additional capital improvements LEASE AGREEMENT - Page 2 DICLEASE.001 upon submission to the City of Tukwila of required plans, permits and documentation, and after obtaining City approval. Said improvements, if permanently fixed to the leased premises, shall become the property of the City of Tukwila at the expiration or termination of this lease unless otherwise agreed. 8. Sub -Leasing. The Duwamish Improvement Club may sub- lease on a daily basis to any other community group wishing to use the premises, providing such groups do not discriminate against race, religion, national origin, sex, age, or physical disability, and provided that the use is not for commercial purposes. Any fees charged by the Duwamish Improvement Club shall be solely for the purposes of recovering utility and clean up costs if applicable.
