HomeMy WebLinkAboutOrd 0713 - Rezone Goverment Lot 7 Property to M-2 kV 9 i Ost /0°6 CITY OF T WASHINGTON ORDINANCE NO. 713 AN ORDINANCE RECLASSIFYING CERTAIN PROP- ERTY FROM R -1 ZONING TO M -2 ZONING, WITHIN THE CITY OF TUKWILA. WHEREAS The owners of the following described property have petitioned the Planning Commission requesting reclassification of said property from R -1 zoning to M -2 zoning in conformity with the comprehensive plan, and WHEREAS Public hearings on said petitionwere held before the Planning Commission and the City Council of the City of Tukwila, and the City Council having received a favorable recommendation from the Planning Commission with respect to the aforementioned petitions; and WHEREAS The City Council finds the requested re- classification to be in furtherance of the public health, safety and general welfare, NOW, THEREFORE, The City Council of the City of Tukwila, Washington, do ordain as follows: That the following described real property is hereby classified as M -2 in accordance with Ordinance No. 251 of the City of Tukwila, as amended, and the City Council hereby adopts the attached map showing said classification for the real prop- erty described as follows: That portion of Government Lot 7, Section 35, Twp. 23 N., Range 4 E.W.M., in King County, Washington, more par- ticularly described as follows: Beginning at a point from which the NW corner of said Government Lot 7 bears S. 0 °58'10" W. 313.17 feet and N. 89 °01'50" W. 505.54 feet, said distances being measured respectively at right angles to and along the North boundary line of said Government Lot, said point of beginning is marked by a concrete monument which is indicated as Point "A" -1- on survey drawing by R. W. Jones and Associates, Engineers and Surveyors, dated 10 -6 -66 and entitled Boundary and Topographic Survey of a Portion of Government Lots 6 and 7, Section 35, T.23 N., R. 4 E.W.M.; thence S. 67 °36'00" E. 248.63 feet to a concrete monument set by R.W. Jones and Associates, Engineers and Surveyors, on October 4, 1966; thence S. 23 °57'22" W. 208.79 feet to a concrete monument also set by said engineers and surveyors, said monu- ment marking the intersection with a line at right angles, said line to be referred to hereinafter in this description as the southwesterly line of the Gaco Western Tract, said monument to be hereinafter referred to in this description as Point "K thence N. 66 °02'38" W. along said southwesterly line of the Gaco Western Tract for a distance of 250.00 feet, more or less, to the southeasterly margin of 57th Ave. S.; thence S. 23 °57'22" W. along said road margin 143.90 feet, more or less, to an intersection with the northwesterly extension of the northeasterly side of the Alaska Seavan Building, said intersection being the True Point of Beginning of the property herein described; thence continuing southwesterly along said road margin to a point of beginning of Tract (a) as described in legal descrip- tion contained in Real Estate Contract between Tokio Toyoshima and Miye JoAnn Toyoshima, his wife, and Gaco Western, Inc., dated August 17, 1966, and re- corded October 17, 1966 under King County Auditor's File No. 6095472; thence southerly along the westerly line of said Tract (a) to an intersection with a line which is parallel to and 538.76 feet southwesterly of as measured at right angles to said southwesterly line of the Gaco Western Tract; thence S. 66 "02'38" E. parallel to said southwesterly line of the Gaco Western Tract for a distance of 207 feet, more or less, to an intersection with the easterly line of said Tract (a); thence N. 16 °29'55" E. along the easterly line of said Tract (a) for a distance of 50 feet, more or less, to an angle point in the boundary line of said Tract (a); thence S. 64 °17'20" E. along the boundary line of said Tract (a) 232 feet, more or less, to the bank of the Green River; thence northerly along said river bank to an intersection with the southeasterly extension of the northeasterly side of the Alaska Seavan Building; thence N. 66 °02'38" W. along said southeasterly extension and along said northeasterly side of said building and along the northwesterly extension of said building line to the True Point of Beginning. SUBJECT TO an easement for ingress and egress and utilities over, across, and under that portion of the foregoing described tract lying westerly of the following described line: Commencing at a monument heretofore referred to in this description as Point "K", said post being on the southwesterly line of the Gaco Western Tract; thence S. 23 °57'22" W. 438.76 feet; thence N. 66 °02'38" W. along a line parallel with said southwesterly line of the -2- Gaco Western Tract fpr a distance of 210.95 feet to concrete monument hereinafter to be referred to as Point "X" in this description; thence S 19 °59'25" W. 100.24 feet to an intersection with a line which is parallel to and 538.76 feet southwesterly of as measured at right angles to said southwesterly line of the Gaco Western Tract, said intersection being the true Point of Beginning of the easterly line of said easement for ingress and egress and utilities; thence N. 19 °59'25" E. along said easterly line of said easement 100.24 feet to said Point "X thence N. 8 °13'05" W. along said easterly line of said easement to an intersection with the easterly margin of 57th Ave. South, said intersection being the terminus of the easterly line of said easement. ALSO Subject to River Protection Easement granted to King County by instrument recorded under Auditor's File No. 5244586. The City Clerk is directed to file a copy of this Ordinance and map with the County Auditor.
