AGREEMENT FOR WESTFIELD MALL RADIO REPEATER SYSTEM
This Agreement is entered into between the City of Tukwila "City and WEA
Southcenter, LLC "Westfield for a radio repeater system.
Whereas, pursuant to the Development Agreement entered into between the City
and Westfield for the redevelopment of Westfield's property known as Westfield
Southcenter (City contract 40 5 -123), Westfield agreed to construct and provide
equipment for the transmission and reception of Valley Communications Center
communications, and
Whereas, Valley Communications Center has authorized the City to enter into a
radio frequency use agreement whereby Westfield may rebroadcast the Valley
Communications Center's frequencies,
Now therefore, the parties agree as follows
Section 1 The City authorizes Westfield to rebroadcast the Valley Communications
Center's radio frequencies WQGP996, WQBH536, WQBH540, and WQGR279
"Frequencies so long as such authorization is in compliance with all local, state and
federal laws and regulations.
Section 2. Westfield shall obtain and operate on its property an 800 MHZ repeater
"Equipment from Spectra Site Communications, LLC "Spectra Site for the purpose
of repeating the Frequencies.
Section 3 Westfield shall maintain ownership of the Equipment and Spectra Site, on
behalf of Westfield, will be responsible for all on going maintenance and annual testing.
The City shall have no ownership rights to the Equipment or any responsibility for on-
going maintenance or annual testing of the Equipment. Westfield shall submit an annual
testing report to the City Fire Marshal to ensure that the Equipment is performing as
designed. Any deficiencies will be corrected by Spectra Site, on behalf of Westfield.
Section 4 This agreement shall remain in effect unless terminated by the City
DA FED this 1 11 day 2008.
