Conditions: A. The following change, and work affected thereby, are subject to all contract
stipulations and covenants;
B. The rights of the "Owner" are not prejudiced;
C. All claims against the "Owner" which are incidental to or as a consequence of
this change are waived; and
D. The Contractor must submit all Field Overhead and Home Office Overhead Rates
for approval in advance of all change orders.
CHANGE:
The proposed work in Change Order No, 5 initially resulted from the discovery of the proposed generator site location at the west
side of was within a stream buffer. This location would create a sizeable amount of mitigation if built in this location. A new site
was needed to be determined. New sites were evaluated and design plans were revised with a location in the sloped lawn area in
front of City Hall. The costs associated with this location were becoming prohibitive Finally a site was chosen in the furthest
westerly stall of the lower parking lot. This is the nearest feasible location in regard to the location of the existing electrical facilities
being connected.
We the undersigned Contractor, have given careful consideration to the change proposed and hereby agree, if this proposal is
approved, that we will provide all equipment, furnish all materials, except as may otherwise be noted above, and perform all
services necessary for the work above specified, and will accept as full payment therefore the prices shown above and below.
This change represents a fair, equitable and complete compensation.

CHANGE:
The proposed work in this change order was the result of discovering that the existing electrical panels were not properly grounded
at Fire Station 52 and thus not within code compliance. Staff directed the contractor to install the grounding system. This change
order will add $785.00 and 1 calendar days to the original contract. The new contract total will become $537,942.00, and the
project duration will increase to 167 calendar days.
We the undersigned Contractor, have given careful consideration to the change proposed and hereby agree, if this proposal is
approved, that we will provide all equipment, furnish all materials, except as may otherwise be noted above, and perform all
services necessary for the work above specified, and will accept as full payment therefore the prices shown above and below.

CHANGE:
The proposed work in this change order is the result of unforeseen conditions during the course of construction. This change adds
an additional circuit for future auxiliary fuel tanks. Circuits were also added to separate existing battery chargers at Station 54 for
safety compliance. The remote annunciator, which was installed per the plans, was directed by the Fire Marshall to be relocated
next to other equipment to comply with requirements. This change order will add $5,750.00 and 15 calendar days to the original
contract. The new contract total will become $537,157.00, and the project duration will increase to 166 calendar days.

Work to be performed:
Please see the encloseded RF1's 4 and 5 for Electrical revision and details. Add extra circuit
for future auxiliary fuel tanks at all three Fire Station sites. Added additional Circuits to
separate the existing battery charger at the Fire Station 54. Relocate the remote annunciator at
Station 54 from adjacent to the ATS' per Fire Marshall's request.
Reason for modification:
Additional circuits were needed to separate new equipment from existing in order to prevent
overloading and tripping of the charging circuit.
The annunciator at Station 54 was relocated at the request of the Fire Marshall. The annuciator
will be relocated from next to the Captain's office to the existing alarm monitoring panel.

CHANGE:
This work is the result of conditions encountered in the field during construction which require additional efforts by the contractor to
complete the proposed systems at Fire Station 52 53. These conditions were because of physical constraints of the existing
buildings and the clearance requirements needed to effectively locate the new equipment. This work includes moving existing
electrical cabinets, wiring, and conduits, to physically accommodate the new equipment required for the generator systems. Repair
work of the existing walls is required to include patching, replacing, and painting both inside and outside wall areas.

CHANGE:
The proposed work in this change order is the result of unforeseen conditions encountered in the field at Fire Stations #52 during
the course of construction. Public Works staff has issued the attached Field Directive #1 to address the additional work items
necessary for the completion of the work at this site. Field Directive #1 involves the excavation of an existing planter area to
provide a code required three foot clearance for maintenance access around the generator. The work also includes hauling and
material disposal, repair of an existing irrigation line, and preparation of the excavated area to provide an accessible, 3 -foot wide
flat area for maintenance required by code.

In response to the requested work under COPOO4R at fire Station 52 provided by Mac Stanton
and dated 17- MAR -09. Please do not construct the proposed retaining wall or remove the
existing wall. Please excavate the adjacent area above the existing, lower retaining wall to
provide a flat earthen area approximately 3 feet measured from the face of wall into the planter
and 3 inches below the top of the wall. Extend each side, a minimum of 3 feet beyond each end
of the generator. Taper slopes at a ratio of 1:1 to daylight at existing grades.
Reason for modification:
To provide a 3 foot minimum clearance area adjacent to the generator for maintenance access.

therefore the parties agree as follows
1 Project. Contractor shall complete all work and furnish all labor, tools, materials, and
equipment for the project entitled "Standby Power Upgrades Year 1" Project No 06 -BG01, including all
changes to the Work and force account work, in accordance with the Contract Documents, as described in
Section 1 -04 2 of the Supplemental General Requirements
2 Payments. Owner shall pay Contractor at the unit and lump sum prices, and by force
account as specified in the Proposal according to the Contract Documents as to time, manner, and condition
of payment. The payments to Contractor include the costs for all labor, tools, materials and equipment for the
Work.
3 Completion Date. Contract time shall commence upon Owner's Notice to Proceed date
The Work under this Agreement shall be completed within the time specified in the Proposal If the Work
under this Agreement is not completed within the time specified, as detailed in the Contract Documents,
Contractor shall pay liquidated damages and all engineering inspection and supervision costs to Owner as
specified in the Proposal
4 Attorney's Fees. In the event litigation is commenced to enforce this Agreement, the
prevailing party shall be entitled to recover its costs, including reasonable attorney's and expert witness fees
5 Disclaimer. No liability of Contractor shall attach to Owner by reason of entering into this
Agreement, except as expressly provided in this Agreement.
6 Counterparts. This Agreement is executed in two (2) identical counterparts, by the parties,
each of which shall for all purposes be deemed an original
