8. In case uncertainty exists which cannot be
determined by application of the foregoing rules, the
Hearing Examiner shall determine the location of such
use district boundaries. Applications for such special
exceptions shall be a Type 3 decision processed
pursuant to TMC 18.108.030.

18.08.050 Title compliance.
Except as provided in this title:
1. No building or structure shall be erected
and no existing building or structure shall be moved,
altered, added to or enlarged, nor shall any land, build-
ing, structure or premises be used, designed or
intended to be used for any purpose or in any manner
other than a use listed in this title as permitted in the
use district in which such land, building, structure or
premises is located.
2. No building or structure shall be erected,
nor shall any existing building or structure be moved,
reconstructed or structurally altered, to exceed in
height the limit established by this title for the use
district in which such building or structure is located.
3. No building or structure shall be erected,
nor shall any building or structure be moved, altered,
enlarged or rebuilt, nor shall any open spaces sur-
rounding any building or structure be encroached upon
or reduced in any manner, except in conformity with
the building site requirements and the area and yard
regulations established by this title for the use district in
which such building or structure is located.
4. No yard or other open spaces, provided
about any building or structure for the purpose of
complying with the regulations of this title, shall be
considered as providing a yard or open space for any
other building or structure.

TITLE 18 — ZONING
Chapter 18.10
LOW DENSITY RESIDENTIAL
(LDR) DISTRICT
18.10.010 Purpose.
This district implements the Low Density
Residential Comprehensive Plan designation, which
allows a maximum of 6.7 dwelling units per net acre.
It is intended to provide low density family residential
areas together with a full range of urban infrastructure
services in order to maintain stable residential
neighborhoods, and to prevent intrusions by
incompatible land uses.

18.10.020 Permitted uses.
The following uses are permitted outright within
the LDR district, subject to compliance with all other
applicable requirements of the Tukwila Municipal
Code.
1. Dwelling — One detached single- family
unit per lot, (includes factory -built or modular home
that meets UBC). '
2. Animal veterinary, including associated
temporary indoor boarding; access to an arterial
required.
3. Public parks, trails, picnic areas and
playgrounds, but not including amusement parks, golf
courses, or commercial recreation.

18.10.030 Accessory uses.
The following uses and structures customarily
appurtenant to a permitted use, and clearly incidental to
such permitted use, are allowed within the LDR
district.
1. Adult day care and adult family homes.
2. Accessory dwelling unit, provided:
a. minimum lot of 7,200 square feet;
b. accessory dwelling unit is no more
than 33% of the square footage of the primary residence
and a maximum of 1,000 square feet, whichever is
less;
c. one of the residences is the primary
residence of a person who owns at least 50% of the
property,
d. dwelling unit is incorporated into the
primary detached single - family residence, not a

e. minimum of three parking spaces on
the property with units less than 600 square feet, and a
minimum of four spaces for units over 600 square feet;

4. Garage or carport (private) not exceeding
1,500 square feet in floor area, provided it is located on
the same lot as the principal use and is subject to the
regulations affecting the main building.
5. Greenhouses (noncommercial) and storage
sheds not exceeding 1,000 square feet in floor area.
6. Home occupations.
7. Parking areas.
8. Private stable, if located not less than 60
feet from front lot line nor less than 30 feet from a side
or rear lot line. It shall provide capacity for not more
than one horse, mule or pony for each 20,000 square
feet of stable and pasture area, but not more than a total
of two of the above - mentioned animals shall be
allowed on the same lot.

18.10.040 Conditional uses.
The following uses may be allowed within the
LDR district, subject to the requirements, procedures,
and conditions established by the Conditional Use
Permits chapter of this title.
1. Cemeteries and crematories.
2. Churches and community center
buildings.
3. Electrical substations -- distribution.
4. Fire and police stations.
5. Libraries, museums or art galleries (public).
6. Schools, preschool, elementary, junior and
senior high schools (public), and equivalent private
schools.
7. Radio, television, microwave, cellular or
observation stations and towers.
8. Recreation facilities (public) including, but
not limited to, sports fields, community centers, and
golf courses.

18.10.050 Unclassified uses. (see Ord- 18161
Landfills and excavations which the responsible
official, acting pursuant to the State Environmental
Policy Act, determines are significant environmental
actions may be allowed within the LDR district, subject
to the requirements, procedures and conditions
established by the Unclassified Use Permits chapter of
this title.

August 3, 1998, has not received a final inspection as of the date of this letter by the City of
Tukwila Building Division.
Per the Uniform Building Code and /or Uniform Mechanical Code, every permit issued by the
building official under the provision of this code shall expire by limitation and become null and
void if the building or work authorized by such permit is not commenced within 180 days from
the date of such permit, or if the building or work authorized by such permit is suspended or

I am writing in request of an extension of Building Permit # D98 -0143 for the address of 13045
So. 42nd St. in Tukwila.
My husband, Keith H. Rousu of Rousu Construction, applied for the permit in late spring of this
year at a time when we thought his health was good. On June 29, Keith was diagnosed with a
cancerous brain tumor. Because the doctors did not know how quickly his condition would
erode, we gambled and picked up permits for two houses in Tukwila in August - thinking that
these projects would give Keith a reason to keep going. We have started the house permit
# D98 -0150 at 4175 So. 131st St., just a few feet away from the permit for which I am
requesting an extension.
Keith's health has declined further and faster than we thought - he has undergone radiation and
several courses of chemotherapy. Because he is physically unable to do on -site work, and
struggles to communicate verbally so that normal construction business can be done by him, I
am trying to carry on his business [with his encouragement and mental assistance] while
providing 24 -hour health care for him.
Because of several setbacks in our construction plan for the house on So. 131st St. that I am
trying to work through, it has prevented me from being able to start the house on So. 42nd St.
After speaking with Brenda in mid - December, we found that we only have until January 6th to
receive our first inspection to keep the permit valid. Is there any way that we could have a
60 -day extension? With the weather and setbacks on the first house, I am simply unable to
complete side -sewer work prior to the foundation excavation and footings for the permit in
question.
This is not your problem at all, but I am requesting your help as to obtain a new permit would be
a financial hardship for us at this stage of Keith's health problems. We are trying hard to work
with the City of Tukwila and finish the current house up to your standards so that we can
complete the next home in a much quicker time frame. Can you please grant us this
extension? We would be most grateful. We can be reached at [425] 788 -9290.
