WHEREAS, protection of the peace, safety, morals of the City of Tukwila and its citizens requires the exercise of the police power to make illegal certain acts relating to prostitution; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN AS FOLLOWS: Title 8 of the Tukwila Municipal Code is amended to add the following Chapter 8.32 entitled "Prostitution 8.32.010. Unlawful Acts. It is unlawful for anyone: (1) To commit or offer or agree to commit any act of prostitution; or (2) To secure or offer to secure another for the pur- pose of committing any act of prostitution; or (3) To knowingly transport a person into or within the City with purpose to promote that person's engaging in prostitution, or procuring or paying for trans- portation with that purpose; or (4) To knowingly receive, offer or agree to receive another into any place or building for the pur- pose of performing an act of prostitution, or to knowingly permit another to remain there for any such purpose; or (5) To direct another to any place for the purpose of committing an act of prostitution; or (6) To knowingly in any way aid, abet or participate in an act of prostitution. 8.32.020. Unlawful behavior. (1) It is unlawful for anyone to loiter in or near any thoroughfare or place open to the public in a manner and under circumstances manifesting the purpose of inducing, enticing, soliciting or procuring another to commit an act of prostitution. (2) Among the circumstances which may be consid- ered in determining whether such purpose is manifested are: that such person is a known prostitute or panderer, repeatedly beckons to, stops, attempts to stop, or engages male passers -by in conversation, or repeatedly stops or attempts to stop motor vehicle operators by hailing, waving of arms or any other bodily gesture. (3) No arrest shall be made for a violation of this subsection unless the arresting officer first affords such person an opportunity to explain such conduct, and no one shall be convicted of violating this subsection if it appears at trial -that any explanation so given was true and dis- closed a lawful purpose. (4) For the purpose of this section, a "known prosti- tute or panderer" is any person who, within one year previous to the date of arrest for violation of this subsection, has within the knowledge of the arresting officer been convicted of violating any law or ordinance of the State of Washington or any jurisdiction within the State defining and pun- ishing acts of soliciting, committing, offering or agreeing to commit prostitution. 8.32.030. Penalty. The violation of or failure to comply with any provision of this chapter shall be punish- able by imprisonment for a period not to exceed one hundred eighty (180) days, or by a fine not exceeding five hundred dollars ($500.00), or by both such fine and imprisonment. 8.32.040. Severability. If any provision of this chapter is duly found by the Courts of the State to be void on grounds of unconstitutionality, the remainder of this chapter shall remain in full force and effect.
