AN ORDINANCE repealing certain sections of
16.16 of the Tukwila Municipal Code; amending
certain sections of 16.16 of the Tukwila
Municipal Code; and adopting by reference the
Fire Prevention Code.
THE CITY COUNCIL OF THE CITY OF TUKWILA DO ORDAIN
AS FOLLOWS:
The Tukwila Municipal Code is hereby amended and j
repealed as follows:
Section 16.16.010 is amended in its entirety as
follows:
16.16.010. Fire Prevention Code. Certain docu-
ments, three copies of which are on file in the Office of the
City Clerk for use and examination by the public, being the 1970
Edition of the Fire Prevention Code, is hereby referred to,
adopted and made a part hereof and declared to be the Fire Pre-
vention Code of the City of Tukwila, as though fully set forth
in this Chapter.
Section 16.16.020 is amended in its entirety to
read as follows:
16.16.020. Adoption of subsequent standards, publi-
cations. By the reference in Section 16.16.010, the Fire Prevention
Code, 1970 Edition together with any and all amendments, modifica-
tions or additions thereto hereafter printed and filed with the City
Clerk as specified in Section 16.16.010, including the adoption of any
subsequent standards and publications or supplements or amendments
to Article 31 of the Fire Prevention Code, are incorporated and made
a part of this chapter as fully and with the same effect as if set
out herein in full.
The following sections are repealed: Sections
16.16.030, 16.16.040, 16.16.050, 16.16.060, 16.16.070, 16.16.080,
16.16.090.
Section 16.16.150 is amended as follows:
16.16.150. Modifications by the Fire Marshal.
The Fire Marshal of the Fire Department shall have power to modify
any of the provisions of the Fire Prevention Code upon application
in writing by the owner or lessee, or his duly authorized agent,
when there are practical difficulties in the way of carrying out
the strict letter of the Code; Provided, however, that the spirit
of the Code shall be observed, public safety secured, and sub-
stantial justice done in each such case. All the particulars
of such modification, when granted or allowed and the decision of
the Fire Marshal thereon shall be entered upon the records of the
Department and a signed copy shall be furnished the applicant.
Section 16.16.160 is amended as follows:
16.16.160. Application, Appeal. Whenever the Fire
Marshal of the Fire Department disapproves an application or refuses
to grant the permit applied for, or when it is claimed that the pro-
visions of the Code do not apply or that the true intent and mean-
ing of the Code have been misconstrued or wrongly interpreted, such
a
applicant may appeal from such decision the City Council within
ten days from the date of the decision appealed. Any such appeal
shall be in writing and after the receipt of any such appeal the City
Council shall set a date of hearing which shall be within thirty days
after the receipt of notice of appeal.

There is added to Section 16.16 the following
Section.
16.16.190. Amendment of Section 1.3 of the 1970
Edition of the Fire Prevention Code. Section 1.3 of the 1970
Edition of the Fire Prevention Code is amended to read as
follows:
"Except in emergency situations the Fire Marshal
or his duly authorized representative shall not enter any build-
ing, structure or premises in the City without the consent of the t
owner or occupant thereof, unless he possesses a reasonable search
warrant authorizing entry and search of the premises."
