As of June 13, 2017, King County District Court will no longer issue after-hours and weekend search warrants for non -district court matters. As such, the City of Tukwila would like to include issuance of after-hours and weekend search warrants to your duties as Presiding Judge of the Tukwila Municipal Court. To compensate you for this additional duty, the City will raise your annual salary to 90% of the current District Court Judges Salary, as set in the Salary Schedule adopted by Washington Citizens' Commission for Salaries for Elected Officials. All other terms of the Memorandum of Understanding you entered into on November 18, 2013 shall remain the same. Please sign the bottom of this Memorandum to indicate agreement. This appointment covers the period from January 1, 2014 through December 31, 2017 and is pursuant to judicial and legal mandates governing such appointments (RCW 3.50.040 and TMC 2.68). The following wages and benefits are provided to you effective January 1, 2014, during the term of your appointment: WAGE: Salary set at 85% of the District Court Judges Salary as set in the Salary Schedule adopted by the Washington Citizens' Commission on Salaries for Elected Officials on an annual basis. The current schedule, adopted on May 22, 2013 is attached hereto. All taxes, social security and related deductions shall be made from your wages. BENEFITS: General Leave: You are entitled to accrue a general leave bank to use for sick leave and/or vacation, as you deem appropriate. This general leave shall accrue at the rate of 12 hours per month to a maximum accrual of 96 hours. Any hours over 96 that are not used are defaulted back to the City. Upon the ending of your appointment, any leave hours, up to a maximum of 96 hours will be paid off at the rate of $70.00 per hour. Holidays: You shall be entitled to the same holidays as the Non -Represented employee group, paid at a prorated rate of 85% commensurate with your hours on the bench. Healthcare/Dental: You have the option of participating in the City of Tukwila Medical/Dental self-insured plan, Group Health Cooperative or waiving this benefit. The City will pay 85% of the premium for you and your dependents. Payments by you will be a minimum of 15% and may be higher if the GHC plan is selected and premiums are higher than the City's self-insured plan. Your share of the premium will be made by payroll deduction. Heskett Court Administrator The purpose of my 11:00 meeting with you is to ask for your re -appointment. It has been an honor to serve your administration and this community for the past two and a half years. In fact, this term — especially the last six months — have been the most professionally and personally rewarding time in my career. Just to highlight some of our court operations successes: • Reorganization and closer management of our court calendars has resulted in a 40% decrease in volume. This overall court operations efficiency, I believe, is reflected in my "Efficiency" rating by King County Attorneys — 9th highest in the County (out of 47). — see attached Bar ratings. • Reorganization resulted in an almost 30% drop in need for interpreters — last year saved $8,000. • Improved court security. • Created court clerk manual and court employee handbook. • Created weekly court clerk training sessions. • Through a jury review calendar, reduced average number of jury trials set from 19 (obviously impossible to hear in two days) to one per day. • Created Relicensing Support Program to help defendants pay old fines and get properly licensed. We've received over $6,000 in previously unpaid fines. • Created treatment referral and court information catalogs and individual handouts to keep defendants and concerned others informed of available options. • Created probation procedural safeguards to drastically reduce chance of liability. I also want to let you know that while I do not live in Tukwila, I am committed to keeping in touch with and contributing to this community. This is a common criticism of judges. The challenge is to find a way to accomplish this and maintain an appearance of impartiality. I have chosen to do this by participating in the local schools. I have taught several law/trial related classes to elementary students (in the court and at their school). Recently, I taught a trial advocacy class at Foster High School and those students will be here on November 17th to hold a mock trial in our courtroom. I am also in contact with the Showalter principal and hope to have a similar presentation for his students. Law Day is held every year in May and I am trying to establish some way to be involved in the local schools to recognize that event. I attached for your review is a summary of the recent King County Bar Judicial Evaluation results and the RCW governing court appointments. 1 look forward to discussing the court's success and my plans for what I hope will be an even more successful next 4 years. The King County Bar Association (KCBA) recently released the results of the 2005 survey of attorneys regarding the performance of King County District and Municipal Court judges. Every four years the KCBA Judicial Evaluation Committee surveys practicing attorneys to evaluate judges. According to the Bar, the purpose of the survey is to improve judicial performance, give feedback to judges, and provide information to appointing officials and voters concerning individual judges and the judiciary as a whole. Attorneys were asked to rate judges in five areas as either unsatisfactory, less than satisfactory, more than satisfactory, or excellent. The survey results rendered positive ratings (satisfactory and above) 77% of the time for individual judges for the following categories: Decision Making, Demeanor, Impartiality, Efficiency, and Overall Performance. Forty-seven judges from King County District Court, Seattle Municipal Court, and all other King County municipalities were evaluated. The survey results are contained in a rather long document; therefore I summarized the following (numbers rounded to whole number): My individual scores Decision Making 85%, Efficiency 91%, Demeanor 97%, Impartiality 88%, Overall Performance 88%. Combined average for all judges was 77%. • Average overall combined ratings for judges in King County: 77% (out of 100). My rating: 90% • My overall combined rating ranks 9th amongst all 47 judges. o Only 1 of 2 who did not receive a single "unsatisfactory" rating in any category. o Number 2 out of 47 in Demeanor category. o 1 of 6 who did not receive a single "unsatisfactory" rating in Demeanor. o 1 of 3 who did not receive a single "unsatisfactory" rating in Impartiality. o 1 of 2 who did not receive a single "unsatisfactory" rating in Efficiency. o 1 of 3 who did not receive a single "unsatisfactory" rating in Decision Making. o 1 of 5 who did not receive a single "unsatisfactory" rating in Overall Performance. Within thirty days after the effective date of the ordinance creating the municipal court, the mayor of each city or town shall appoint a municipal judge or judges of the municipal court for a term of four years. The terms of judges serving on July 1, 1984, and municipal judges who are appointed to terms commencing before January 1, 1986, shall expire January 1, 1986. The terms of their successors shall commence on January 1, 1986, and on January 1 of each fourth year thereafter, pursuant to appointment or election as provided in this chapter. Appointments shall be made on or before December 1 of the year next preceding the year in which the terms commence. The legislative authority of a city or town that has the general power of confirmation over mayoral appointments shall have the power to confirm the appointment of a municipal judge. A person appointed as a full-time or part-time municipal judge shall be a citizen of the United States of America and of the state of Washington; and an attorney admitted to practice law before the courts of record of the state of Washington: PROVIDED, That in a municipality having a population less than five thousand persons, a person who has taken and passed by January 1, 2003, the qualifying examination for a lay candidate for judicial officer as provided by rule of the supreme court may be the judge.
