BACKGROUND Jim Haggerton, Mayor The City Council is currently deliberating and reviewing the proposed development agreement between the City and La Pianta, LLC. The development agreement, as written, includes a provision for the City to vacate portions of Southcenter Parkway /57 Avenue South and Frager Road. Washington State Law provides specific procedures for cities to follow when vacating public right -of -way. The first step is for the City Council to adopt a resolution setting a public hearing date, which the attached resolution will accomplish. Adopting this resolution in no way obligates the City to actually approve the street vacation or approve the development agreement MAYOR'S RECOMMENDATION Adopt the attached resolution, which will set a public hearing date for the proposed street vacations of June 1, 2009. WHEREAS, the City of Tukwila, by its own petition, has initiated vacation procedures for a portion of Southcenter Parkway /57th Avenue South and Frager Road, generally located between South 180th Street and South 200th Street; and WHEREAS, RCW 35.79.010 requires setting a public hearing by resolution; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. A public hearing regarding the requested vacation of a portion of the right -of -way abutting Southcenter Parkway /57th Avenue South and Frager Road, more particularly described on the attached map, shall be held before the Tukwila City Council in the City Council Chambers at Tukwila City Hall, 6200 Southcenter Boulevard, Tukwila, Washington, on June 1, 2009, which is not less than 20, nor more than 60 days from the date of passage of this resolution, at which time all persons interested in said right -of -way vacation are invited to appear and be heard. Section 2. The City Clerk is directed to post written notice of pendency of the public hearing in three public places in the City of Tukwila and in one additional conspicuous place on the right -of -way sought to be vacated at least 20 days prior to the date set for the public hearing.
