In a letter dated 27 August 1999 we replied, stating our willingness to correct any conditions in that or any other building owned by us that might pose a hazard for the City's water supply, while also claiming that the City Administration has no authority to deny applications for commercial tenant - improvement permits in general, and the permit (D99 -0256) for which our application was then pending in particular, because of the actual or suspected noncompliance of backflow- prevention devices on the subject property. Public Works replied to our claim in its letter dated 9 June 2000 with respect to a subsequent permit application (D2000 -100), and we appealed the underlying decision to the City Administrator on 26 July 2000. That appeal is pending. In accord with our intent to correct any hazardous conditions, we have obtained written evaluations and proposals from several contractors with respect to the compliance of our backflow- prevention facilities with applicable regulations. These contractors include Fire Systems West, McKinstry Company, Anderson- Magruder Company, Archer Construction, and Ace Fire Protection Systems. We have encountered major discrepancies among the measures recommended by these contractors. We are unable to evaluate their conflicting recommendations without more expert advice. Therefore, we wish to extend the planning process no later than through January 2001 (subject to acceleration in the event of the discovery of any imminent hazard) in order to obtain the consulting and design services of an independent expert with respect to the determination and remediation of any backflow hazards arising from the facilities at the above - described and other properties. This expert would produce plans for any remediation measures found necessary. The expert whom we wish to employ for this purpose is Richard L. The new configuration included 15 large classrooms along with office and computer space. The Boeing Education Network (BEN) studio is used for televised education to remote sites. We understand your letter to say that the Department of Community Development will not approve the permit until and unless we agree to upgrade existing backflow- prevention facilities of the building to those that are currently required for new buildings. We request a reconsideration of that decision for the following reasons: 1) It has not been established that any upgrade of the subject building's backflow- prevention devices is required. Backflow - prevention devices are already installed on the subject property, including a Stockham vault check valve and a UL- listed Automatic Sprinkler Corporation of America Model 153 Alarm Check Valve on the connection between the public water supply and the building's fire sprinkler system. We understand the already - installed backflow- prevention devices to comply with Backflow Prevention Assemblies Approved for Installation in Washington State, January 1999, published by the Division of Drinking Water Environmental Health Programs, Washington State Department of Health, page 1, attached. If they so comply, then we understand them to comply with TMC 14.06.010(b), which incorporates this Washington State listing by reference. Under TMC 14.06.030, a mandated upgrade to the existing equipment would appear to require a determination by the Director of Public Works of a site - specific hazard unity Development, 99/08/27, page 2 - to the City's water supply. No such determination is included in your letter or in the letter from Public Works. 2) The denial of a building permit is not a legally authorized procedure by which to require backflow- prevention devices. TMC 14.06.060 defines the absence of required backflow prevention to be a "public nuisance" and prescribes enforcement remedies. The specific remedy is a 30-day abatement notice, enforced with the discontinuation of water service to the premises. The only other remedies permitted by TMC 14.06.060 are remedies for the abatement of public nuisances. Your letter does not assert that the denial of a building permit is a remedy allowed by the TMC for the abatement of a public nuisance. 3) The re9uirement being 'imposed by Public Works is not enforceable without further legislative authority. Public Works' letter says that it "requires installation of backflow prevention on ... older buildings at the time building improvements are made." Such an invalidation of an entire class of nonconforming uses has, we believe, no basis in Chapter 14.06 of the TMC. In general, the TMC allows nonconforming uses arising from code changes to remain in existence except where expressly provided in ordinances, such as the "when sold" exception in the Tukwila Fire Code and the Sign Amortization Program. Because no such exception appears in Chapter 14.06, it is reasonable to infer that Public Works does not have the authority to require every building where permittable improvements are made (no matter how minor) to upgrade its backflow- prevention devices to comply with the current code. Were it to be determined that the interconnection of the subject building or any other building we own in Tukwila poses a hazard for the City's water supply, we would be willing to comply with all legally applicable requirements, whether or not we were making improvements. Maintain fire extinguisher coverage throughout. Portable fire extinguishers shall be securely installed on the hanger or in the bracket supplied, placed in cabinets or wall recesses. The hanger or bracket shall be securely and properly anchored to the mounting surface in accordance with the manufacturer's instructions. The extinguisher shall be installed so that the top of the extinguisher is not more than 5 feet above the floor and the clearance between the bottom of the extinguisher and the floor shall not be less than 4 inches. This chapter; shall not apply to: 1. An authorized representative of the United States Government, the State of Washington, or any incorporated city, town, county, township, irrigation district, reclamation district, or other municipal or political corporation or subdivision of this state; 2. Officers of a court when they are acting within the scope of their office; 3. Public utilities operating under the regulations of the utilities and transportation commission in construction, maintenance, or development work incidental to their own business; 4. Any construction, repair, or operation incidental to the discovering or producing of petroleum or gas, or the drilling, testing, abandoning, or other operation of any petroleum or gas well or any surface or underground mine or mineral deposit when performed by an owner or lessee; 5.
