You are hereby directed to make the herein described changes to the plans and specifications or do the following described work not
included in the plans and specifications on this contract:
NOTE: This change order is not effective until approved by the "Owner" and a notice to proceed is issued.
Conditions: A. The following change, and work affected thereby, are subject to all contract stipulations and covenants;
B. The rights of the "Owner" are not prejudiced;
C. All claims against the "Owner" which are incidental to or as a consequence of this change are waived; and
D. The Contractor must submit all Field Overhead and Home Office Overhead Rates for approval in advance of all
change orders.
CHANGE:
During the construction, several of the vaults, and other design elements found on the plans prepared by the King County Reclaimed
Water Division were determined to be undersized for the planned water pipe systems. As a result, King County Engineers re- designed
the plans. This necessitated the return of the original vaults and use of larger vaults along with additional materials and labor costs.
After negotiations with Precision Earthworks, Inc., along with review and approval by King County, Change Order No 2 will add
$17,242.26 and 23 calendar days to the contract. The new contract total will be $114,909.60 (without sales tax).
We the undersigned Contractor, have given careful consideration to the change proposed and hereby agree, if this proposal is
approved, that we will provide all equipment, furnish all materials, except as may otherwise be noted above, and perform all services
necessary for the work above specified at no additional costs. This change represents a fair, equitable and complete compensation.

CHANGE:
This project will allow Foster Golf Links to use King County reclaimed water for irrigation. During the construction of the pond filling
structure, groundwater from the pond was found to be seeping into the underground vault. This was allowing water to fill the vault
and would jeopardize the newly installed equipment making in non functional. To alleviate this, a drain system was added to
relieve flow to a lower elevation nearby.
The work described was required as a result of changed field conditions. This C.O. No. 1 totals $2,818.34. The new contract total
will be 97,667.34 (without sales tax).

for the above -named project. Bidders shall take this Addendum into consideration when

system (as shown on the Plans) after a successful pressure test has been witnessed by the
Owner's and King County's representative and after a purity test has been satisfactorily
evidenced. The Contractor shall provide all ancillary items to include temporary plugs, caps,
blow -offs, and blocking and otherwise construct the entire proposed facilities up to the point of
connection for the pressure and purity tests."

ADD The Contractor shall only be allowed to make those connections to the existing system as
directed by note 2 on drawing C104 and elsewhere on the plans. All new reclaimed water
pipelines shall be pressure tested by the Contractor and pressure testing shall be witnessed by
the Owner's and King County's representative prior to continuing work. All disinfection purity
tests shall be satisfactorily evidenced to the Engineer prior to continuation of work The
Contractor shall provide all ancillary items to include temporary plugs, caps, blow -offs, and
blocking and construct the entire proposed facilities required for pressure and disinfection purity
tests."

DELETE "The Contractor shall jet and vactor 300 feet of existing 16" diameter ductile iron pipe
and dispose of the vactured material into existing sanitary sewer manhole located near the
George Long City shops." and REPLACE with "The existing 16" diameter ductile iron pipe shall
be flushed in accordance with Note 2 on drawing C104. The Owner's and King County's
representatives shall witness the flushing of the existing 16" diameter RWR pipeline The
flushing operation will be considered complete after the line has been flushed for a minimum of
30 minutes and the reclaimed water discharged to the sewer is deemed clear by the Owner's
and King County's representatives. If the flushing discharge remains murky and discolored after
3 hours of flushing, the Owner's representative may elect to have the Contractor jet and vactor
300 feet of existing 16" diameter ductile iron pipe and dispose of the vactured material into the
existing sanitary sewer manhole as identified on drawing C101. If jetting and vactoring is
selected, additional pipe excavation and replacement of the thrust block may be required. If the
Owner's representative elects to have the Contractor jet and vactor the existing 16" diameter
ductile iron pipe, the Contractor shall be paid on a time and materials basis for this work."

pipelines not disinfected, unless they are connected with a Washington State Department of
Health approved air gap." and REPLACE with "No connection shall be made between the

DELETE "Sections of pipe to be disinfected shall first be flushed to remove any solids or
contaminated material that may have become lodged in the pipe. If no hydrant is installed at the
end of the main, then a tap shall be provided, which is large enough to develop a velocity of at
least 3 feet per second (fps) in the main. Taps required by the contractor for temporary or
permanent release of air, chlorination or flushing purposes shall be provided by the contractor
as part of the construction of reclaimed water mains at no cost to the Owner and King County."
and REPLACED with "Sections of pipe to be disinfected shall first be flushed to remove any
solids or contaminated material that may have become lodged in the pipe. Refer to Drawing
C104, Note 2 for the sequencing of new pipe flushing and disinfection. Taps and temporary pipe
restraints required by the Contractor for temporary or permanent release of air, chlorination or
flushing purposes shall be provided by the Contractor as part of the construction of reclaimed
water mains at no cost to the Owner and King County."

ALL OTHER REQUIREMENTS OF THE CONTRACT DOCUMENTS REMAIN IN EFFECT.
All bidders shall acknowledge receipt and acceptance of this Addendum No. 1 in the
space provided on the Proposal Signature Sheet or by signing in the space provided
below and submitting the signed addendum with the bid package. Failure to acknowledge
receipt of this Addendum No. 1 may be considered as an irregularity in the Bid Proposal and the
City reserves the right to determine whether the bid will be disqualified.

AGREEMENT FORM
CONTRACT NO. 09 -056

THIS AGREEMENT is made and entered into on this ��day of W4 20_Q!5, by and between
the City of Tukwila, Washington "Owner and Precision Earthworks, Inc. "Contractor Now,
therefore the parties agree as follows:
1. Project. Contractor shall complete all work and furnish all labor, tools, materials, and
equipment for the project entitled "Foster Links Reclaimed Water Pipeline Extension Project" Project No.
92 -WT06, including all changes to the Work and force account work, in accordance with the Contract
Documents, as described in Section 1 -04.2 of the Supplemental General Requirements.
2. Payments. Owner shall pay Contractor at the unit and lump sum prices, and by force
account as specified in the Proposal according to the Contract Documents as to time, manner, and condition
of payment. The payments to Contractor include the costs for all labor, tools, materials and equipment for the
Work.
3. Completion Date. Contract time shall commence upon Owner's Notice to Proceed date.
The Work under this Agreement shall be completed within the time specified in the Proposal. If the Work
under this Agreement is not completed within the time specified, as detailed in the Contract Documents,
Contractor shall pay liquidated damages and all engineering inspection and supervision costs to Owner as
specified in the Proposal.
4. Attorney's Fees. In the event litigation is commenced to enforce this Agreement, the
prevailing party shall be entitled to recover its costs, including reasonable attorney's and expert witness fees.
5. Disclaimer. No liability of Contractor shall attach to Owner by reason of entering into this
Agreement, except as expressly provided in this Agreement.
6. Counterparts. This Agreement is executed in two (2) identical counterparts, by the parties,
each of which shall for all purposes be deemed an original.
