TITLE 18 — ZONING (Ord. 1865 §25, 1999; Ord. 1830 §13, 1998; Ord. 1758 §1(part), 1995) Page 18 -41 MEMO FOR RECORD DATE: 8/31/1999 FROM: Duane SUBJECT: Easement to obtain required setback for walk -in cooler - Pete's Flying Aces Casino History: While making other inspections at the site Ray noticed that a walk -in cooler had been installed next to the building. He posted a stop work order stating that a permit was required. The property owner applied for a permit and somewhere along the line Bob had a conversation with the property owner at the counter and told her that they didn't have the required setback required by the UBC for this structure. This was before Bob or anyone else in the plan review process had submitted any comments to Brenda. Apparently the property owner then had a architect draw up a site plan showing the property lines that would have to be included in a no -build easement obtained from the adjacent property owner, and had a no- build easement document drawn up and notarized. The easement document was then submitted to me for review. I didn't think it was worded properly to satisfy the Building Division needs so I discussed it with City Attorney Noe. After reviewing it he made suggested recommendations for changing the wording and gave it back to me on 8/30/99. At that time it was nay intention to contact the applicant to notify them of the changes that would be required to make the no -build easement document acceptable to the city. However, before I made any contact with the applicant, Nora and I had a discussion on 9/30/98 (I can't remember who or what initiated the discussion) and she told me that during her review she had determined that a boundary line adjustment would be required in order for the applicant to meet the zoning code requirement for a 10 foot setback. She said she had had a discussion with somebody from Pete's who was upset with this requirement because they had thought the no -build easement was all that was needed. On 8/31/99 I discussed this subject with Bob and he told me that to meet UBC requirements the Type V -N cooler adjacent to the property line would normally require a 20' setback from the property line. However, he had determined that since the fire department has been requiring these type coolers to be sprinklered, the sprinkler system could reduce the setback requirements from 20' to 10'. Otherwise the setback requirement for V -N construction would be 20 feet. 1 also discussed this issue with Steve, Jack, Brenda and Nora on 8/31/99. Nora said she had prepared a memo to go along with her plan review comments that a boundary line adjustment would be required. BOTTOM LINE: Planning will require a boundary line adjustment that will provide a 10 foot setback from the side of the cooler to the property line. If that boundary line adjustment is done, and the cooler is in fact sprinklered, then there will be no requirement for a no -build easement. Therefore, no further action regarding the wording of the attached no -build easement document is anticipated.
