payments. Cascade shall have a right of recovery from the defaulting Member on behalf of <br />each Member. Cascade may commence such suits, actions or proceedings at law or in equity, <br />including but not limited to suits for specific performance, as may be necessary or appropriate <br />to enforce the obligations of this Contract against any defaulting Member. Cascade's right to <br />enforce payments in this regard may be assigned to a treasurer, trustee, credit enhancement <br />provider or other entity. Amounts recovered by Cascade as payment of amounts due shall be <br />passed through to each Member in proportion to the share that each assumed, in cash or in <br />credit against future Member Charges as the Board shall determine. <br />(d) The prevailing party in any such suit, action or proceeding, shall be entitled to <br />recover its reasonable attorney fees and costs against the defaulting Member. <br />ARTICLE 8. Planning <br />Section 8.1 Water Supply Plan. Cascade must plan for its Members' water supply <br />needs. That planning shall be to be compatible with the equivalent planning responsibilities <br />of other wholesale water providers and with state, county and city planning responsibilities <br />under the Growth Management Act. The Board must adopt, and may from time to time <br />amend, a Water Supply Plan that must be based on no less than a twenty- (20) year planning <br />horizon. Cascade shall coordinate its planning effort with local and regional utilities and <br />other appropriate agencies and work to encourage cooperative region -wide planning and <br />coordination. <br />Each Member shall actively participate in Cascade's water supply planning and shall <br />provide to Cascade accurate data regarding its facilities and operations together with good- <br />faith estimates of future needs and a description of any involvement in the development of <br />Cascade Interlocal Contract -36- <br />Amended and Restated <br />October 26, 2011 <br />
