Page 3 <br />Public Hearing Minutes <br />August 23, 2018 <br />Seth Terry, Architect, for the applicant addressed questions for the Commission. <br />There were no public comments. <br />The public hearing was closed. <br />DELIBERATION: <br />Commissioner Mann said they have set standards and if a developer makes efforts to meet those <br />standards, adding more requirements is excessive. She said removing the gate removes the <br />potential for cafe seating. She encouraged open space sidewalk cafes. <br />Commissioner Hansen asked staff some clarifying questions regarding removal of the gate and <br />staff deferred to the applicant. The applicant said they have agreed to remove the gate. <br />Commissioner Watters said the area would require a redesign to make the grass count as open <br />space. <br />MOTION: <br />Commissioner Hansen made a motion to approve Case Number`L18-0022 with staff's finding <br />and conclusions, and conditions one, two, four, five and six, based on the applicant's response in <br />Exhibit A, which he requested become a permanent part ofthe record. He moved to revise <br />condition number three to leave it up to the applicant to decide whether they remove the gate. <br />Commissioner Mann seconded the motion, The motion passed three in favor, Commissioner <br />Watters opposed. <br />Commissioner Hansen asked for clarification from Commissioner Watters. He asked whether her <br />objection was because of the motion made on condition number three. Commissioner Watters said <br />for the record she was supportive ofthe project and had no concerns but was opposed to condition <br />number three. <br />Commissioner Hansen moved to revise his motion to approve Case Number L18-0022 with <br />staffs finding and conclusions, and conditions one, two, four, five and six, based on the <br />applicant's response in Exhibit A, which he requested become a permanent part of the record. He <br />moved to strike condition number three. <br />Noted: <br />Commissioner Martinez said they support the growth in the Urban Center, and they come to a <br />unanimous decision. <br />Commissioner Hansen thanked the applicant for bringing a great project to the Urban Center, <br />and he thanked staff for an excellent job. <br />Commissioner Mann thanked the staff for working diligently on both projects and for bringing <br />forth projects they can be proud of. <br />9 <br />
