Page 2 <br />Public Hearing Minutes <br />August 23, 2018 <br />Dale Sweeney, Architect and the applicant addressed questions regarding maintenance of the <br />building color materials fading, and lighting. <br />The public hearing was closed. <br />DELIBERATION: <br />Commissioners Martinez and Hansen were both present at the July hearing and were in <br />consensus that the applicant met all their obligations and addressed everything satisfactorily, as <br />instructed. <br />Commissioner Watters said the design looks good, and complimented the applicant on the trees <br />proposed, but said she wanted to encourage some taller trees. <br />Commissioner Mann said she is pleased with the development and the August proposal looks <br />good now. She said it is pleasing to have a developer listen to recommendations and be willing to <br />work with their design group to meet the design standards put together by the City and the <br />Commissioners. She said her only concern was the additional lighting. <br />Commissioners Hansen and Watters asked for some clarification on the proposed trees. <br />MOTION: <br />Commissioner Hansen made a motion to approve case number L18-0029 with staff's findings <br />recommendations and three conditions, an additional condition for lighting on the south facade of <br />the building, and three informational items.; Commissioner Mann Seconded the motion. All were <br />in favor. <br />CASE NUMBER: 18-0022 <br />APPLICANT: Will Ralph <br />REQUEST: Design Review approval for development of a five -story 177 room <br />Element By Westin hotel and related site improvements. <br />LOCATION: Southeast corner of Andover Park E and Industry Dr., APN <br />0223400070 <br />Max Baker, Assistant Planner, Department of Community Development asked the appearance of <br />fairness questions. There were no disclosures, and no one had any objections to any of the <br />Commissioners hearing the project... <br />Max Baker gave the presentation for staff. He gave an overview of the review process, provided <br />background information on the site and project, and design review criteria. In the staff report there <br />are a total of six recommended conditions, which the applicant has provided responses to since the <br />packet went out. Staff requested to enter into the record Exhibit A, which addresses staff's <br />condition number one. The applicant also submitted Exhibit B, which addresses staffs condition <br />number two. The applicant has responded to and has agreed to meet the requirements of the six <br />conditions of approval.. Staffed noted that the TUC code allows for flexibility in the landscape <br />parking lot design, but the intent is to provide shade, so it is cooler during the summer months. <br />This is one of the conditions the applicant has agreed to meet through the revisions. Staff <br />recommended approval with six conditions. <br />There was extensive discussion on condition number three regarding removing the gate between <br />the patio area and the sidewalk along Andover Park East. The Commission were not all in <br />consensus regarding this condition. The majority of the Commission concluded instead of making <br />it a condition of approval condition number three should be struck. The Commissioners decided <br />that they would leave it up to the applicant to determine what they felt was best regarding the <br />removal of the gate. Staff confirmed that the applicant meets the open space requirement without <br />the patio. <br />8 <br />
