DECLARATION OF COVENANTS, CONDITIONS <br />AND RESTRICTIONS OF RECORD <br />OF <br />RIVERTON COTTAGES <br />(DRAFT) <br />ARTICLE I <br />Authority and Purpose <br />WHEREAS, the Covenants, Conditions and Restrictions (CC &R's) have been uniformly adopted <br />throughout the Riverton Cottages on the XXth of Month, 2011, and <br />WHEREAS, since 1994 the State of Washington revised its laws regulating and controlling homeowner <br />organizations, and <br />WHEREAS the Riverton Cottages is indeed subject to these revisions and additions, as a duly <br />incorporated homeowners association in the state of Washington and <br />WHEREAS the following set of CC &R's were approved in their entirety by a 2/3 majority of a quorum of <br />the membership at the annual meeting held in Month, 2011. <br />Now, therefore, the following Covenants, Conditions, Reservations, Easements and Restrictions are <br />hereby established and approved with respect to all lots, units, and real property interests. <br />These Covenants amend and supersede in their entirety those Covenants, Conditions, Restrictions, <br />Easements and Reservations previously adopted as affecting the properties which are subject hereto. <br />These Covenants, Conditions, Restrictions, Easements and Reservations shall run with the land and shall <br />be binding upon the owners of each lot, unit or other real property interest, their heirs, successors and <br />assigns. <br />ARTICLE II <br />Definitions <br />Section 1. "Association" shall mean Riverton Cottage Owners Association, a Washington corporation, <br />organized pursuant to the Washington Non Profit Corporation Act (RCW 24.03) and better known and <br />referred to throughout these documents as "Association." <br />Section 2. "Assessments" shall be charges levied and collected by Association to cover costs incurred <br />while protecting and maintaining the health, tranquility, and welfare of the community.
