desire to negotiate. Supplemental agreements thus completed will be <br />signed by an authorized representative of the Employer and Association, <br />with a copy to the Human Resources Director. <br />Should either party (through the Association President, Police Chief, or their <br />designee), having been notified of the proposed supplemental language, <br />not respond by requesting a meeting of the joint committee within thirty (30) <br />calendar days, the proposed language shall be considered acceptable and <br />shall be forwarded to the other party for signature. Supplemental <br />agreements thus completed shall become a part of this Agreement. <br />In those cases where the parties cannot agree, the parties agree, upon the <br />request of either party, to expeditiously proceed directly to request a PERC <br />mediator within a 30-day period and, if necessary, to proceed to interest <br />arbitration on the issue as provided in RCW 41.56 et seq., using one of the <br />arbitrators selected in the grievance procedure. The parties agree to waive <br />the appointment of partisan arbitrators and that the matter will be heard by <br />an arbitrator selected in the same manner as is provided in the grievance <br />procedure. Neither party may be required to arbitrate a proposal, which, if <br />granted, would require the Arbiter to change an express term of this <br />Agreement. <br />SECTION 7.3 Work Rotation. The rotation of personnel between shifts shall <br />be minimized within the limitations of providing an adequate and efficient work <br />force at all times, as determined by the Employer. <br />SECTION 7.4 Personnel File: <br />A. Ownership. The personnel files are the property of the <br />Employer. The Employer agrees that the contents of the personnel <br />files, including the personal photographs, shall be confidential and shall <br />restrict the use of information in the files to internal use by the Police <br />Department. This provision shall not restrict such information from <br />becoming subject to due process by any court of administrative tribunal <br />or subject to a public records request.
