PREAMBLE <br />This mutual agreement has been entered into by the Tukwila Police <br />Sergeants Association (hereinafter referred to as "Association'), and the City <br />of Tukwila (hereinafter referred to as "City" or "Employer'). The purpose of <br />this Agreement is the promotion of harmonious relations between the <br />Association and the City; the establishment of equitable and peaceful <br />procedures for the resolution of differences; and the establishment of rates of <br />pay, hours of work, and other terms and conditions of employment. <br />ARTICLE 1 - RECOGNITION AND BARGAINING UNIT <br />SECTION 1.1 Association. The City of Tukwila recognizes the Association <br />as the exclusive bargaining representative of the Police Department for all <br />employees in positions certified by the PERC as being within the Association's <br />bargaining unit; provided that neither party waives its right to petition the <br />Public Employment Relations commission to add to or delete from the above <br />list in accordance with established time frames and procedures. <br />SECTION 1.2 Negotiations Sessions. Employees who serve on the <br />Association negotiations committee shall be allowed time off from duty with <br />pay to attend negotiation sessions with the Employer during working hours, <br />provided prior notification is given to the Chief, or his/her designee, and the <br />time is mutually agreed upon. For the purposes of negotiations with the <br />Employer, the number of official representatives of the Association shall be <br />limited to four members. <br />SECTION 1.3 Association Business. The City shall afford Association <br />representatives a reasonable amount of time while on -duty status to consult <br />with appropriate management and/or aggrieved employees, provided that the <br />Association representatives and/or aggrieved employees contact their <br />immediate supervisors, indicate the general nature of the business to be <br />conducted, and request necessary time without interference with assigned <br />duties. Employees who are subpoenaed to appear as fact witnesses during <br />a Civil Service Hearing, PERC hearing or Labor arbitration may be allowed to <br />attend without loss of pay, only during their testimony.
