Air Quality <br />The Contractor agrees to comply with all applicable standards, orders, or regulations <br />issued pursuant to the Clean Air Act, as amended, 42 USC §§ 7401, et seq. The <br />Contractor agrees to report each violation to the County and understands and agrees <br />that the County will, in turn, report each violation as required to assure notification <br />to FTA and the appropriate U.S. Environmental Protection Agency (EPA) Regional <br />Office. <br />The Contractor agrees to include this clause in each subcontract exceeding $100,000 <br />financed in whole or in part with Federal assistance provided by FTA. <br />C. Clean Water <br />The Contractor agrees to comply with all applicable standards, orders, or <br />regulations issued pursuant to the Federal Water Pollution Control Act, as amended, <br />33 USC §§ 1251 et seq. The Contractor agrees to report each violation to the County <br />and understands and agrees that the County will, in turn, report each violation as <br />required to assure notification to FTA and the appropriate Environmental Protection <br />Agency (EPA) Regional Office. <br />The Contractor agrees to protect underground sources of drinking water consistent <br />with the provisions of the Safe Drinking Water Act of 1974, as amended, 42 USC <br />§§ 300h et seq. The Contractor agrees to include these requirements in each <br />subcontract exceeding $150,000 financed in whole or in part with Federal assistance <br />provided by FTA. <br />D. Use of Public Lands <br />The Contractor agrees that no publicly owned land from a park, recreation area, or <br />wildlife or waterfowl refuge of national, state, or local significance as determined <br />by the federal, state or local officials having jurisdiction thereof, or any land from <br />a historic site of national, state, or local significance may be used for the Project <br />unless the FTA makes the specific findings required by 49 USC § 303. <br />28 <br />
