18.45.075 Mitigation Sequencing <br />Applicants shall demonstrate that reasonable efforts have been examined with the <br />intent to avoid and minimize impacts to critical areas and critical area buffers. When an <br />alteration to a critical area or its required buffer is proposed, such alteration shall be <br />avoided, minimized or compensated for in the following order of preference: <br />1. Avoiding the impact altogether by not taking a certain action or parts of an <br />action; <br />2. Minimizing critical area or critical area buffer impacts by limiting the degree <br />or magnitude of the action and its implementation, by using appropriate technology, or by <br />taking affirmative steps to avoid or reduce impacts; <br />3. Rectifying the impact by repairing, rehabilitating or restoring the affected <br />environment; <br />4. Reducing or eliminating the impact over time by preservation and <br />maintenance operations during the life of the action; <br />5. Compensating for the impact by replacing, enhancing, or providing substitute <br />resources or environments; and/or <br />6. Monitoring the impact and taking appropriate corrective measures. <br />Section 27. TMC Section 18.45.080 is hereby reenacted to read as follows: <br />18.45.080 Wetlands Designations, Ratings and Buffers <br />A. WETLAND DESIGNATIONS. <br />1. For the purposes of TMC Chapter 18.45, "wetlands" are defined in the <br />Definitions chapter of this title. A wetland boundary is the line delineating the outer edge <br />of a wetland established in accordance with the approved federal wetland delineation <br />manual and applicable regional supplement. <br />2. Wetland determinations and delineation of wetland boundaries shall be <br />made by a qualified professional, as described in TMC Section 18.45.040. <br />3. Wetland determinations and delineation or wetland boundaries must be <br />conducted within no more than five years prior to the date of permit application. <br />B. WETLAND RATINGS. <br />Wetlands shall be designated in accordance with the Washington State Wetlands <br />Rating System for Western Washington (Washington State Department of Ecology, 2014, <br />Publication # 14-06-029); or as otherwise amended by Ecology, as Category I, Il, III, or <br />IV. <br />w:\Legislative Development\Critical Areas update 2-25-20 <br />MD:bjs Review and analysis by Barbara Saxton Page 17 of 87 <br />
