the general condition and extent of such areas. Cutting down trees and shrubs within the <br />shoreline jurisdiction is not covered under this provision. Excavation, filling, and <br />construction of new landscaping features, such as concrete work, berms and walls, are <br />not covered in this provision and are subject to review; <br />b. Noxious weed control within shoreline jurisdiction, if work is selective only <br />for noxious species; is done by hand removal/spraying of individual plants; spraying is <br />conducted by a licensed applicator (with the required aquatic endorsements from the <br />Washington State Department of Ecology if work is in an aquatic site); and no area -wide <br />vegetation removal or grubbing is conducted. Control methods not meeting these criteria <br />may still be approved under other provisions of this chapter. <br />D. Tree Retention and Replacement. <br />1. Retention. <br />a. As many significant trees and as much native vegetation as possible are <br />to be retained on a site proposed for development or re -development, taking into account <br />the condition and age of the trees. As part of a land use application such as but not <br />limited to subdivision or short plat, design review, or development permit review, the <br />Director of Community Development or the Board of Architectural Review may require <br />alterations in the arrangement of buildings, parking or other elements of proposed <br />development in order to retain significant non-invasive trees, particularly those that <br />provide shading to the river. <br />b. Topping of trees is prohibited and will be regulated as removal with tree <br />replacement required. <br />c. Trees may only be pruned to prevent interference with an overhead <br />utility line with prior approval by the Director. The pruning must be carried out under the <br />direction of a Qualified Tree Professional or performed by the utility provider under the <br />direction of a Qualified Tree Professional. The crown shall be maintained to at least 2/3 <br />the height of the tree prior to pruning. Pruning more than 25% of the canopy in a 36 month <br />period shall be regulated as removal with tree replacement required. <br />2. Permit Requirements. Prior to any tree removal or site clearing, a Type 2 <br />Shoreline Tree Removal and Vegetation Clearing Permit application must be submitted <br />to the Department of Community Development (DCD) containing the following <br />information: <br />a. A vegetation survey on a site plan that shows the diameter, species and <br />location of all significant trees and all existing native vegetation. <br />b. A site plan that shows trees and native vegetation to be retained and <br />trees to be removed and provides a table showing the number of significant trees to be <br />removed and the number of replacement trees required. <br />c. Tree protection zones and other measures to protect any trees or native <br />vegetation that are to be retained for sites undergoing development or re -development. <br />Cl.
