7.2.a A use valuation shall be prepared consistent with MAI accepted principles <br />for the purpose of quantifying the value to the System of the use of Cedar Hills Landfill for <br />Disposal of Solid Waste over a specified period of time (the valuation period). The County shall <br />establish a schedule of annual use charges for the System's use of the Cedar Hills Landfill which <br />shall not exceed the most recent use valuation. Prior to establishing the schedule of annual use <br />charges, the County shall seek review and comment as to both the use valuation and the <br />proposed payment schedule from MSWAC. Upon request, the County will share with and <br />explain to MSWAC the information the appraiser requests for purposes of developing the <br />appraiser's recommendation. <br />7.2.b Use valuations and the underlying schedule of use charges shall be <br />updated if there are significant changes in Cedar Hills Landfill capacity as a result of opening <br />new Disposal areas and as determined by revisions to the existing Cedar Hills Regional Landfill <br />Site Development Plan; in that event, an updated appraisal will be performed in compliance with <br />MAI accepted principles. Otherwise, a reappraisal will not occur. Assuming a revision in the <br />schedule of use charges occurs based on a revised appraisal, the resulting use charges shall be <br />applied beginning in the subsequent rate period. <br />7.2.c The County general fund shall not charge use fees or receive other <br />consideration from the System for the System's use of any transfer station property in use as of <br />the effective date of this Agreement. The County further agrees that the County general fund <br />may not receive payments from the System for use of assets to the extent those assets are <br />acquired with System revenues. As required by chapter 43.09.210 RCW, the System's use of <br />assets acquired with the use of other separate County funds (e.g., the Roads Fund, or other funds) <br />
