acting within the scope of their authority. Transporters or generators of waste who are not <br />officers or employees of the City or County are not included as agents of the City or County for <br />purposes of this Section. <br />8.4 Each Party by mutual negotiation hereby waives, with respect to the other Party <br />only, any immunity that would otherwise be available against such claims under the Industrial <br />Insurance provisions of Title 51 RCW. <br />8.5 Unacceptable Waste <br />8.5.a All waste generated or collected from within the corporate limits of the <br />City which is delivered to the System for Disposal shall be in compliance with the Resource <br />Conservation and Recovery Act (42 U.S.C. § 6901 et seq.) (RCRA), chapters 70.95 and 70.105 <br />RCW, King County Code Title 10, King County Board of Health Rules and Regulations, the <br />Solid Waste Division operating rules, and all other Federal, State and local environmental health <br />laws, rules or regulations that impose restrictions or requirements on the type of waste that may <br />be delivered to the System, as they now exist or are hereafter adopted or amended. <br />8.5.b For purposes of this Agreement, the City shall be deemed to have <br />complied with the requirements of Subsection 8.5.a if it has adopted an ordinance requiring <br />waste delivered to the System for Disposal to meet the laws, rules, or regulations specified in <br />Subsection 8.5.a. However, nothing in this Agreement is intended to relieve the City from any <br />obligation or liability it may have under the laws mentioned in Subsection 8.5.a arising out of the <br />City's actions other than adopting, enforcing, or requiring compliance with said ordinance, such <br />as liability, if any exists, of the City as a transporter or generator for improper transport or <br />Disposal of regulated dangerous waste.
