releases of pollutants or hazardous or dangerous substances or wastes to the environment is dealt <br />with under Sections 8.6 and 8.7. <br />8.5.c The City shall hold harmless, indemnify and defend the County for any <br />property damages or personal injury caused solely by the City's failure to adopt an ordinance <br />under Subsection 8.5.b. In the event the City acts to defend the County under this Subsection, the <br />County shall cooperate with the City. <br />8.5.d The City shall make best efforts to include language in its contracts, <br />franchise agreements, or licenses for the collection of Solid Waste within the City that allow for <br />enforcement by the City against the collection contractor, franchisee or licensee for violations of <br />the laws, rules, or regulations in Subsection 8.5.a. The requirements of this Subsection 8.5.d shall <br />apply to the City's first collection contract, franchise, or license that becomes effective or is <br />amended after the effective date of this Agreement. <br />8.5.d.i If waste is delivered to the System in violation of the laws, <br />rules, or regulations in Subsection 8.5.a, before requiring the City to take any action under <br />Subsection 8.5.d.ii, the County will make reasonable efforts to determine the parties' responsible <br />for the violation and will work with those parties to correct the violation, consistent with <br />applicable waste clearance and acceptance rules, permit obligations, and any other legal <br />requirements. <br />8.5.d.ii If the violation is not corrected under Subsection 8.5.d.i and <br />waste is determined by the County to have been generated or collected from within the corporate <br />limits of the City, the County shall provide the City with written notice of the violation. Upon <br />such notice, the City shall take immediate steps to remedy the violation and prevent similar <br />future violations to the reasonable satisfaction of the County which may include but not be <br />
