(until commingled with other earnings and revenues included in Gross Cascade Revenue) or <br />held in a special account for the purpose of paying a rebate to the United States Government <br />under the Code; (b) taxes and other income and revenue which may not legally be pledged for <br />revenue bond debt service; (c) improvement district assessments; (d) federal or state grants <br />allocated to capital projects; (e) payments under Bond Insurance or other credit enhancement <br />policy or device; (f) insurance or condemnation proceeds used for the replacement of capital <br />projects or equipment; (g) earnings in any construction fund or bond redemption fund; (h) <br />deposits to any rate reserve or rate stabilization fund or account; or (i) any revenues generated <br />by any Independent Supply except those amounts that are payable to Cascade pursuant to this <br />Contract or another interlocal agreement. <br />"Independent Supply" or "Independent Supplies" means a Member's Water <br />Supply Assets that are not part of the Supply System. <br />"Member" or "Members" means one or more member agencies of Cascade. <br />"Member Charges" means all payments that Cascade Members are required by this <br />Contract to make to Cascade, including but not limited to all Rates and Charges, RCFCs, <br />dues, assessments and other payments from Members. <br />"Net Cascade Revenue" means Gross Cascade Revenue less Operations and <br />Maintenance Costs. <br />"Non- Member" means any person or agency that is not a party to this Contract. <br />"Operations and Maintenance Costs" or "O &M Costs" means all expenses <br />incurred by Cascade to operate and maintain the Supply System in good repair, working order <br />and condition, including without limitation, payments made to any other public or private <br />Cascade Interlocal Contract -4- <br />Amended and Restated <br />October 26, 2011 <br />
