1-18 Incorporation of FTA Terms <br />The preceding provisions include, in part, certain Standard Terms and Conditions required by <br />the U.S. Department of Transportation, whether or not expressly set forth in the preceding <br />contract provisions. All contractual provisions required by the U.S. Department of <br />Transportation, as set forth in FTA Circular 4220.1F, dated November 1, 2008, are hereby <br />incorporated by reference. Anything to the contrary herein notwithstanding, all FTA <br />mandated terms shall be deemed to control in the event of a conflict with other provisions <br />contained in this Contract. The Contractor agrees not to perform any act, fail to perform any <br />act, or refuse to comply with any County requests that would cause the County to be in <br />violation of the FTA terms and conditions. <br />1-19 Sensitive Security Information <br />The Contractor shall protect, and take measures to ensure that its subcontractors at each tier, protect <br />"sensitive security information" made available during the administration of a third party contract <br />or subconstract to ensure compliance with 49 U.S.C. 40119 (b) and implementing DOT <br />regulations, "Protection of Sensitive Security Information," 49 CFR Part 15, and with 49 U.S.C. § <br />114 (r) and implementing Department of Homeland Security Regulations, "Protection of Sensitive <br />Security Information," 49 CFR Part 1520. <br />1-20 Substance Abuse <br />Contractor and its subcontractors agrees to comply with U.S. OMB Guidance, <br />"Governmentwide Requirements for Drug -Free Workplace (Financial Assistance)," 2 CFR <br />Part 182, and U.S. DOT regulations, "Governmentwide Requirements for Drug -Free <br />Workplace (Financial Assistance)," 49 CFR Part 32, that implement the Drug -Free <br />Workplace Act of 1988, 41 USC §§ 701 et seq., including any amendments to these U.S. <br />DOT regulations when they are promulgated, and "Prevention of Alcohol Misuse and <br />Prohibited Drug Use in Transit Operations," 49 CFR Part 655, that implement 49 USC § <br />5331. <br />1-21 Seatbelt Use <br />Contractor shall adopt and promote on-the-job seatbelt use policies and programs for its employees <br />and other personnel that operate company owned, rented, or personally operated vehicles in <br />compliance with Federal Executive Order No. 13043, "Increasing Seatbelt Use in the United <br />States," April 16, 1997, 23 U.S.C. § 402 note. This provision shall be included in each third party <br />subcontract involving this project. <br />19191 <br />
