WHEREAS, certain notification and other commitments under this successor Agreement <br />arise before January 2013, but the delivery of Animal Services under this Agreement will <br />not commence until January 1, 2013; and <br />WHEREAS, nothing in this Agreement is intended to alter the provision of service or <br />manner and timing of compensation and reconciliation specified in the 2010 Agreement <br />for services provided in 2012; and <br />WHEREAS, the City pursuant to the Interlocal Cooperation Act (RCW Chapter 39.34) , is <br />authorized and desires to contract with the County for the performance of Animal <br />Services; and <br />WHEREAS, the County is authorized by the Interlocal Cooperation Act, Section 120 of the <br />King County Charter and King County Code 11.02.030 to render such services and is <br />willing to render such services on the terms and conditions hereinafter set forth; and <br />WHEREAS, the County is offering a similar form of Animal Services Interlocal Agreement <br />to cities in King County listed in Exhibit C-1 to this Agreement, and has received a non- <br />binding statement of intent to sign such agreement from those cities; <br />NOW THEREFORE, in consideration of the promises, covenants and agreements <br />contained in this Agreement, the parties agree as follows: <br />1. Definitions. Unless the context clearly shows another usage is intended, the <br />following terms shall have these meanings in this Agreement: <br />a. "Agreement" means this Animal Services Interlocal Agreement for 2013 <br />Through 2015 between the Parties including any and all Exhibits hereto, <br />unless the context clearly indicates an intention to reference all such <br />Agreements by and between the County and other Contracting Cities. <br />b. "Animal Services" means Control Services, Shelter Services and Licensing <br />Services combined, as these services are described in Exhibit A. Collectively, <br />"Animal Services" are sometimes referred to herein as the "Program." <br />c. "Enhanced Control Services" are additional Control Services that the City <br />may purchase under certain terms and conditions as described in Exhibit E <br />(the "Enhance Control Services Contract"). <br />d. "Contracting Cities" means all cities that are parties to an Agreement. <br />e. "Parties" means the City and the County. <br />f. "Contracting Parties" means all Contracting Cities and the County. <br />g. "Estimated Payment" means the amount the City is estimated to owe to the <br />County for the provision of Animal Services over a six month period per the <br />Document Dated 5-29-12 <br />2 <br />
